A motion was made by Phillip Surles to Motion. The motion was seconed by Allen McAlister.   Muzaib goes over the staff report and explains that this is a SUP.  Right now this site already has a SUP for the same use, but it expires February 5th, 2020.  Staff has looked at the site and has determined that there are several zoning codes and ordinance code that they are not following.  The site as of now does not meet our zoning regulation.  Landscaping, parking, and some others.  If they do go into improving the site they will need to replat the site.  Staff recommends Denial. Russel DeLotter I own the RV sales next door.  We have been there 7 years, we are super super successful and we are growing every year.  We are nationwide and have sold to every one in Sanger.  We are growing.  We would like to take over next door and we would go by any rules you recommend.  We have had no problems and growing every month.  Super successful in paying tax and bringing in people from all over the country. Commissioner Amendola said just to clarify it wasn't us that approved the last SUP. What we are having to do is look at the existing rules.  We have to follow the rules. Hernandez said they are not asking to not follow the rules but be mindful of the situation.  We will improve that area but they don't know what the DOT will take. He said nobody can say how we didnt follow the rules. Surles says I leas 101 N Berry and y'all are great neighbors, and yall are doing a great job. It does look good. Amendola what is meant with out improvements. Muzaib says they need to bring it to code. We propose that we bring it to code when we know what the DOT is going to do.  I do not want to put bushes in the front without knowing what they are doing.  Please make a decision that is business smart. Amendola reminds them their time is up. Russell states that the Tx DOT guy told him that it would be 3 to 5 years until it starts. So a 2 year SUP would be excellent for the City.  I am not the other guy.  I am not a child I am an adult and run businesses. Board discusses further. Commissioner Surles says right now it is not a good business spot he would rather see someone that has done a good job stay there. Commissioner Turner asks is it only the landscape? Ramie says there was parking requirements, and other requirements. Commissioner Stone says let me ask a question?  So you are waiting on Tx. Dot money is your reasoning right?  You will take care of it once you get the money. He then asks So Quality RV are you going to do the improvements? Russell says yes sir. Commissioner Amendola states it hasn't been done in two years. Commissioner Sulres says I don't think we should ask them to invest in something that is going to go away. Commissioner Turner states I believe parking is an issue. Each property owner shall keep the Drainage and Detention Easement clean and free of debris, silt, and any substance which would result in unsanitary conditions or obstruct the flow of water, and the Town shall have the right of ingress and egress for the purpose of inspection and supervision of maintenance work by the property owner to alleviate any undesirable conditions which may occur. The natural drainage through the Drainage and Detention Easement is subject to storm water overflow and natural bank erosion to an extent which cannot be definitely defined. Neither the City, nor the County shall be held liable for any such damages of any nature resulting from the occurrence of these natural phenomena, or resulting from the failure of any structure or structures, within the Easement.
