Consider, Discuss and Act on the Minor Plat of Lot 1, Block A of Heaths Hollow Addition, Being
1.967 Acres, in the City of Sanger, and Generally Located Approximately 300 Feet North of the
Intersection of Duck Creek Road and I35 Service Road.
Muzaibs speaks briefly and goes over the staff report. He explains no public improvements needed
and they are just moving from Chapman Rd. Staff recommends approval with the condition all
comments are met by City Council.
Commissioner Amendola makes a motion to approve with the condition that all City comments are
met by the date set.
Commissioner McAlister seconded the motion. Motion passes unanimously.

Muzaibs speaks briefly and goes over the staff report. He explains that it is the final plat. Staff
recommend approval with the condition that all comments are met by City Council. He explains he
just received the revised plat today and staff hasn't had time to look.
Commissioner Stone makes a motion to approve with the condition that all comments are met.
Commissioner Surles seconded. Motion passes unanimously.

Conduct a Public Hearing and Consider, Discuss and Act on Ordinance # 010220 Regarding a
Specific Use Permit (SUP) for a Trailer/RV Sales or Rental use on a Property Zoned as B2
(Business District 2), and Generally located West of I35 and Approximately 200 Feet South of
the Intersection of West Bolivar Street and I35 Service Road.
A motion was made by Phillip Surles to Motion. The motion was seconed by Allen McAlister.
Muzaib goes over the staff report and explains that this is a SUP. Right now this site already has a
SUP for the same use, but it expires February 5th, 2020. Staff has looked at the site and has
determined that there are several zoning codes and ordinance code that they are not following. The
site as of now does not meet our zoning regulation. Landscaping, parking, and some others. If they
do go into improving the site they will need to replat the site. Staff recommends Denial.
Commissioner Amendola said so he doesnt meet our codes?

I came up with this concept a few years ago. It was purchased as a car lot. He explained it was a
dump.
When we came to the council we asked for an RV sales. At the time the Council did not want us to
improve the back they wanted us to improve the front. That is why we paved the front. 6 months
later we were notified that the DOT is going to take about 40 feet away from the front. We are not
sure when. It depends on the DOT and we own the property on the corner. Since it has been the
RV we have improved the front. The DOT will not pay us for the pavement. At the time they new
we did not have any bushes in the front. Alina was here at that time and we said as soon as we can
we can do the bushes. Then the DOT told us that they were taking the property. We dont want to
spend good money and then they take it.
Russel DeLotter
I own the RV sales next door. We have been there 7 years, we are super super successful and we
are growing every year. We are nationwide and have sold to every one in Sanger. We are growing.
We would like to take over next door and we would go by any rules you recommend. We have had
no problems and growing every month. Super successful in paying tax and bringing in people from
all over the country.
Commissioner Amendola said just to clarify it wasn't us that approved the last SUP. What we are
having to do is look at the existing rules. We have to follow the rules.
Hernandez said they are not asking to not follow the rules but be mindful of the situation. We will
improve that area but they don't know what the DOT will take. He said nobody can say how we
didnt follow the rules.
Surles says I leas 101 N Berry and y'all are great neighbors, and yall are doing a great job. It does
look good.
Amendola what is meant with out improvements.
Muzaib says they need to bring it to code.
We propose that we bring it to code when we know what the DOT is going to do. I do not want to
put bushes in the front without knowing what they are doing. Please make a decision that is business
smart.
Amendola reminds them their time is up.

Fuller said he can understand not making the improvements now because of Tx Dot, but if they were
done two years ago you would have two years under your belt.
Ramie said I dont believe staff told them where to pour the drive. Staff did say they are not allowed
to park on grass.
Hernandez argues that the City told him to pour in the front.
Fuller stops him and said they gave him two years to complete bushes, and follow the rules and you
did not complete what was asked. I understand you are a different tenant, but we approved it two

Commissioner Fuller said 2023 is when the start date.
Russell states that the Tx DOT guy told him that it would be 3 to 5 years until it starts. So a 2 year
SUP would be excellent for the City. I am not the other guy. I am not a child I am an adult and run
businesses.
Board discusses further.
Commissioner Surles says right now it is not a good business spot he would rather see someone that
has done a good job stay there.
Commissioner Turner asks is it only the landscape?
Ramie says there was parking requirements, and other requirements.
Commissioner Stone says let me ask a question? So you are waiting on Tx. Dot money is your
reasoning right? You will take care of it once you get the money.
He then asks So Quality RV are you going to do the improvements?
Russell says yes sir.
Commissioner Amendola states it hasn't been done in two years.
Commissioner Sulres says I don't think we should ask them to invest in something that is going to go
away.
Commissioner Turner states I believe parking is an issue.
Russell says he has two options for that we can do what you recommend or they can park at the
current location with easy access.

1st REVIEW COMMENTS – Final Plat (Sanger Meadows Addition Phase 1 Final Plat)
Request is for a Final Plat of Sanger Meadow Addition Phase 1, being approximately 15.928 acres
of land into 10 residential lots prepared by Texas Surveying submitted on 01/15/2020. Below are
the comments that should be addressed prior to recommendation to City Council for approval.
Resubmit the revised plat along with a response letter addressing all comments.

This plat is hereby adopted by the Owners and approved by the City of Sanger (Called “City”)
subject to the following conditions which shall be binding upon the Owners, their heirs,
grantees, successors and assigns: The Portion of Block A, as shown on the plat called “Drainage
and Detention Easement”. The Drainage and Detention Easement within the limits of this
addition, will remain open at all times and will be maintained in a safe and sanitary condition by
the owners of the lot or lots that are traversed by or adjacent to the Drainage and Detention
Easement. Neither the City not the County will be responsible for the maintenance and
operation of said Easement or for any damage to private property or person that results from
conditions in the Easement, or for the control of erosion. No obstructions to the natural flow or
storm water run‐off shall be permitted by construction of any type of building, fence or any
other structure within the Drainage and Detention Easement, as herein above defined, unless
approved by the City Engineer and County Engineer. Provided, however, it is understood that in
the event it becomes necessary for the City or County to erect of consider erecting any type of
drainage structure in order to improve the storm drainage that may be occasioned by drainage
in or adjacent to the subdivision, then in such event, the City or County shall have the right to
enter upon the Drainage and Detention Easement at any point, or points, to investigate, survey
or to erect, construct and maintain any drainage facility deemed necessary for drainage
purposes. Each property owner shall keep the Drainage and Detention Easement clean and free
of debris, silt, and any substance which would result in unsanitary conditions or obstruct the
flow of water, and the Town shall have the right of ingress and egress for the purpose of
inspection and supervision of maintenance work by the property owner to alleviate any
undesirable conditions which may occur. The natural drainage through the Drainage and
Detention Easement is subject to storm water overflow and natural bank erosion to an extent
which cannot be definitely defined. Neither the City, nor the County shall be held liable for any
such damages of any nature resulting from the occurrence of these natural phenomena, or
resulting from the failure of any structure or structures, within the Easement. NOTE ADDED IN FULL
As driveway culvert sizing was not provided with separate plans or reports and is needed for driveway culvert
permits with the County, provide a chart on the plat with Lot, Block, min. culvert size, & slope. This information
