Case Overview
The subject property is zoned as SF-10 (Single-Family Residential District – 10). This district
allows the proposed use of a Religious Charitable or Philanthropic Institution only with an SUP.
The site will be a community pantry and basic health services center by First Refuge Ministries, a
501c3 non-profit organization under First Baptist Denton Ministry Center. The site is owned by
First Baptist Church Sanger and is platted as Sims Addition Block 2. The applicant has requested
an SUP for a period of 12 months which can be renewed annually.
The property has one main structure and two accessory buildings behind the main structure. The
existing building to be used for the proposed use is currently a 3 bedroom, 2 bathroom single
family home of approximately 2080 square feet. The applicant will be remodeling the interior of
the building for the community pantry and basic health services. A preliminary site plan has been
submitted and a final site plan is requested by the staff before a recommendation of approval to
City Council is made. Staff is currently waiting to receive a detailed site plan from the applicant
along with a response form addressing all of staff’s comments.

In recommending that a specific use permit for the premises under consideration be granted, the
Planning and Zoning Commission shall determine that such uses are harmonious and adaptable to
building structures and uses of adjacent property and other property in the vicinity of the premises
under consideration, and shall make recommendations as to requirements for the paving of streets,
alleys and sidewalks, means of access to public streets, provisions for drainage, adequate off-street

1st REVIEW COMMENTS – SUP (713 S 5th Street – First Baptist Church)
Request is for a SUP for “Religious, Charitable, or Philanthropic Institution” land use for
property (713 South 5th Street) within SF-10 Zoning District, being approximately 0.57 acres,
described as Sims Addition Block 2, submitted on 6/12/2019. Below are the comments that
should be addressed prior to recommendation to City Council for approval. Submit a response
letter addressing all comments.
Planning
1. Provide a site plan drawn to scale and showing the general arrangement of the project,
together with essential requirements such as:
a. Off-street parking facilities for the project
b. Location and construction of signs if any
c. Size, height, construction materials and location of buildings, and uses to be
permitted
d. Visual screening such as walls, landscaping, and fences
e. Means of ingress and egress to public streets
2. Provide total square footage of the building on the site plan
3. Add front, side and rear yard setbacks according to SF-10 Zoning district on the site plan.
4. Parking would be calculated as 1 space per 300 square feet. Shared parking with First Baptist
Church property across the street would be encouraged. Should you choose to have shared
parking, a letter signed by the owner of the First Baptist Church property would be required,
stating that First Baptist Church parking (701 S 3rd Street) would be used for the property 713
South 5th Street.
5. Landscaping of twenty (20) percent of the total lot area is required. Not less than forty (40)
percent of the total required on-site landscaping shall be located in the designated front yard.
6. A landscaped buffer yard of minimum 10 feet is required adjacent to single family uses on the
west and south of the property. It shall contain the following elements:
a. One (1) tree (three-inch caliper minimum) shall be planted every 50 linear feet or
portion thereof of the bufferyard.
b. The remainder bufferyard shall be landscaped with shrubs, lawn, ground cover and
other landscape materials.
c. Any required fencing and screening walls shall be placed behind the required
bufferyard.
d. Such landscape buffer shall be counted toward meeting the minimum square
footage of required landscaping for the site.
7. Staff will recommend approval of the SUP to City Council only if all comments are
addressed by Wednesday, July 17, 2019. (Informational Comment)

The Specific Use Permit application for Sanger Circle Park submitted on 6/12/19 has been reviewed. The
City of Sanger Engineering Department has the following comments that should be addressed prior to
recommendation to City Council for approval:
Please verify with Planning department if platting of the property is required with this SUP.
An application for Specific Use Permit (SUP) shall be accompanied by a site plan drawn to scale
and showing:
o the general arrangements of the project,
o together with essential requirements such as
off‐street parking facilities;
size, height, construction materials and locations of buildings
and the uses to be permitted;
location and construction of signs;
means of ingress and egress to public streets;
visual screening such as walls, landscaping and fences;
and the relationship of the intended use to all existing properties and land uses
in all directions to a minimum distance of two hundred (200) feet.
I understand property is currently under common ownership with properties to north & east.
Verify with Planning is shared parking agreement is required if parking is not provided on‐site.
Property does not have existing driveway access on Loop 138 – Fifth St?
o Access to property shall be required. Provide drive off Fifth St or access easement across

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANGER, DENTON
COUNTY, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND
THE OFFICIAL ZONING MAP ESTABLISHED THROUGH CHAPTER 14 “PLANNING
AND ZONING” OF THE CODE OF ORDINANCES, EXHIBIT A “ZONING ORDINANCE
OF THE CITY OF SANGER, TEXAS”, AND SECTION 4 “ZONING DISTRICT MAP”, TO
GRANT A SPECIFIC USE PERMIT (SUP) TO ALLOW A RELIGIOUS, CHARITABLE,
AND PHILANTHROPIC INSTITUTION USE AT APPROXIMATELY 0.57 ACRES OF
LAND ZONED AS SF-10 “SINGLE-FAMILY RESIDENTIAL DISTRICT - 10”;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING
FOR A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE IN
ACCORDANCE WITH SECTION 1.109 OF THE CODE OF ORDINANCE FOR
VIOLATIONS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, all Requests for A Specific Use Permit (SUP) were duly filed with the City
of Sanger, Texas, concerning the hereinafter described properties;
WHEREAS, due notice of hearings were made in the time and manner prescribed by law
and the Planning and Zoning Commission of the City of Sanger, Texas, duly covered and
conducted public hearing for the purpose of assessing a request for a Specific Use Permit (SUP)
on the hereinafter described properties located in the City of Sanger, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SANGER, TEXAS:
SECTION 1. That a Specific Use Permit (SUP) to allow a Religious, Charitable, and
Philanthropic Institution use is hereby granted for a period of 12 months starting from the date of
approval of the SUP by City Council. This is an approximately 0.57-acre site, described as Sims
Addition, Block 2 and shown in Exhibit A, generally located west of South 5th Street and 130 feet
north of the intersection of South 5th Street and Turtle Creek.
SECTION 2. All ordinances or parts of ordinances in conflict herewith are, to the extent
of such conflict, hereby repealed.
SECTION 3. It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any
word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining portions of this Ordinance, since the same
would have been enacted by the City Council without the incorporation in this Ordinance of any
such unconstitutional word, phrase, clause, sentence, paragraph, or section.
SECTION 4. Any person, firm or corporation who shall violate any of the provisions of
this article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance
with the general penalty provision found in The Code of Ordinances, Section 1.109 General
Penalty for Violations of Code.
SECTION 5. This ordinance will take effect immediately from and after its passage and
the publication of the caption, as the law and Charter in such cases provide.

Case Overview
The applicant is proposing to replat the Lots 1-5, Block A of Sanger Industrial Park with a total
area of 5.258 acre to create 2 commercial lots of 0.938 acres (Lot 1-R), and 4.230 acres (Lot 2-R).
A 60’ common access and utility easement (0.332 acres) is provided south of Lot 1-R to access
properties east of the proposed lots. The property is located in I-1 (Industrial District).
A Church Building will be constructed on Lot 1-R which will be accessed via a 51’ concrete drive
on the 60’ common access easement. The property is served by existing City of Sanger water along
North 5th Street, and by City sewer line running behind the proposed lots. Electric service will be
provided by CoServ Electric.
The proposed replat meets City of Sanger Zoning Regulations but does not meet City of Sanger
Subdivision Regulations at this time. Staff comments have been provided to the applicant.
Notification Response Form
Staff mailed twenty (20) public hearing notices to the owners of properties within 200 feet of the
subject property. No response forms were received for the proposed replat at the time of this report.
Staff Recommendation
Staff recommends APPROVAL WITH A CONDITION that all staff comments will be
addressed by Wednesday, July 17th, 2019.
Actions for Planning & Zoning Commission
The Planning & Zoning Commission should approve the plat if it finds it to be in conformance
with the subdivision requirements.
Future Actions
The City Council is scheduled to consider the application at the regular meeting on Monday,

Project Description
The proposed development is located in Denton County, in the City of Sanger along
North 5th St. The property in question is zoned I-1 industrial, and the neighboring land use
is agricultural and commercial.
The applicant wishes to combine the existing five lots (R291009, R291010, R291011,
R291012, R291013), a total of 5.258 acres, into two lots: 0.938 acres owned by Grace
Bible Church, and 4.230 acres owned by Eagle Farms Inc. A 60’ common access and
utility easement will be provided along the east side of the lot owned by Grace Bible
Church.
A church building will be constructed for Grace Bible Church on the smaller lot (0.938
acres). Access will be provided via a 51’ concrete drive constructed within the
aforementioned 60’ common access and utility easement.
An existing city water line runs in front of Grace Bible’s lot, along North 5th St. and an
existing sewer line is present behind the lot. These will be sufficient to provide service for
the proposed development. CoServ will provide the electrical services.
Allison Engineering Group is taking the role of applicant in this submittal and all future
correspondence regarding this application may be directed to Lawrence Holdorf of
Allison Engineering Group.

Request is for a Replat of 5.590 acres of Lots 1-R and 2-R, Block A, Sanger Industrial Park
prepared by Landmark Surveyors, LLC submitted on 6/26/2019. Below are the comments that
should be addressed prior to recommendation to City Council for approval. Resubmit the revised
plat along with a response letter addressing all comments.
Planning
1. Add a 15’ P.U.E. along front of the lots.
2. City would like to keep the existing 55’ common access and U.E along the front of the
lots.
3. Plat must be based on a current title report.
4. Show centerline of existing streets. Dimension from centerline to edge of existing and
proposed right-of-way.
5. Describe and locate all permanent survey monument, pins, and control points and tie and
reference the survey corners to the Texas State Plane Coordinate System North Zone

Engineering Review
The Replat application for Sanger Industrial Park submitted on 6/12/19 has been reviewed. The City of
Sanger Engineering Department has the following comments that should be addressed prior to
recommendation to City Council for approval:
The purpose of the application checklist is for the individual items to be checked off by applicant
or plan preparer to affirm that the items have been addressed on the submittal. Please resubmit
completed checklist.
Tie corners to State Plane Coordinates. Show coordinates POB and another corner. Provide note
regarding coordinate system.
Extend U.E. to northern limit across 25’ DE on Lot 5, Tract 2, Block A
Area shown as 60’ common access & UE needs a lot number and ownership/dedication
language.
Show 5th St ROW width.
Civil construction plans have not been found for parent development. As this is a replat please
provide:
o Exhibit/survey with existing utilities, existing topo
o Existing & proposed drainage plan showing how runoff from lots is going to be directed
to TXDOT drainage system or Ranger Branch tributaries.
o Grading plan showing preliminary grading plans & drainage improvements.
o Utility plan for any off‐site improvements needed to service development.
A plan and profile of the proposed storm sewers/drainage swales, showing hydraulic data, pipe
grades and sizes, manholes, inlets, pipe connections, outlet structures, etc., in conformance with
the criteria as shown in Section 6, Improvements. Unless otherwise approved by the City, scales
shall be one‐inch equals forty feet (1" = 40') horizontally and one‐inch equals four feet, five feet
or six feet (1" = 4', 5' or 6') vertically. Each plan shall show the seal and signature of the
registered professional civil engineer who prepared the plans. Each sheet shall include north
point, scale, date and benchmark description to mean sea level datum; and
A plan of all the other utilities, showing the relative locations proposed for the water, sewer,
storm sewer and gas mains, utility poles, TV and electrical services, street lighting, traffic‐control
signs, and street signs, and acknowledged by the appropriate representative of each agency
involved.
Proposed monumentation along 5th street shall meet TXDOT monumentation requirements
rather than set iron pins. Other corners shall meet City permanent survey reference marker
monument requirements rather than S.I.P.s

Check TXDOT Drainage System. If any public drainage is directed across subject property
additional drainage easements may be required.
Additional easements, grading, drainage, & utility improvements may be required with
development of lots.
Sidewalk shall be required with development of lots. Provide pedestrian access easement
behind UE along street frontage.
Additional ROW dedication is required on Lot 5 along IH‐35 Service Road.

the preliminary plat and provided staff comments to the applicant. The property will be required

landscaping regulations. Applicant has not submitted the revised plat and response letter at this
time.
Staff Recommendation
The plat does not meet City of Sanger Subdivision Regulations at this time. Staff recommends
APPROVAL WITH THE FOLLOWING CONDITIONS:

PRELIMINARY PLAT CHECKLIST
The plat shall be drawn to a scale if not more than two hundred feet to the inch (1” = 200’). The information to be included and the
procedure for submittal are as follows:
Existing Features:
1) The boundary line (accurate in scale) of the tract to be subdivided.
2) The location, widths, and names of all existing or platted streets or other public ways or adjacent to the tract,
existing permanent buildings, railroads, rights -of-way, and other important features, such as abstract line s,
political subdivision or corporation lines, and school district boundaries.
3) Existing sewer mains, water mains, drainage culverts or other underground structures within the tract and
immediately adjacent thereto with pipe sizes, grades, and locations indicated.
4) Contours with intervals of two feet (2’) or less, referred to mean sea level datum. In areas where the terrain is
relatively flat, supplementary contours shall be shown so that the average horizontal distance between said lines
does not exceed two hundred feet (200’).
5) The names of adjacent subdivisions and/or the names of record owners of adjoining parcels of unsubdivided land.

Submittals for preliminary plats shall include plans, documents, and information adequate for the review of the
provision of public improvements to the properties involved. This includes but is not limited to streets, water services,
wastewater services, franchise utilities, street lighting, and stormwater detention.

Dear Development Services:
We are providing this Letter of Intent for a proposed development located at the
southeast corner of Lois Road and Interstate Highway I35 within the city limits of the
City of Sanger, Texas. On behalf of Sodhi & Rai, Inc., we are submitting a Preliminary
Plat.
The proposed project is a convenience store and fueling facility. It consists of 13,932
square feet building (2,100 square feet restaurant space, two 2,100 square feet retail
spaces, and 7,632 square feet convenience store), 8-regular gas pumps, 5-separate
diesel pumps, and 2- separate canopies. Additionally, the site will contain an
approximate 1,600 square feet stand alone, 2-bay tire shop.
Water and wastewater services will be provided by connecting to existing City of
Sanger public utility lines. Drainage improvements will be designed in accordance
with the City’s drainage ordinance. We will coordinate with the City and the Texas
Department of Transportation (TXDOT) for driveway connections to Lois Road and
the IH35 service road.

1st REVIEW COMMENTS – Preliminary Plat (Sportsman 2)
Request is for a Preliminary Plat of 4.084 acres of Lot 1, Block A, Sportsman II prepared by
Eikon submitted on 6/12/2019. Below are the comments that should be addressed prior to
recommendation to City Council for approval. Resubmit the revised plat along with a response
letter addressing all comments.
Planning
1. Add a note stating the purpose of the plat.
2. Revise the title block to include lot number and block letter along with the subdivision
name.
3. Change Block 1 to Block A.
4. Property is located in B-2 zoning district. All B-2 zoning district standards including
setback requirements will apply.
5. Add 15’ public utility easement along all property boundaries.
6. Add a 15’ utility easement from north property boundary to the building for extension of
electric line.
7. Where necessary to provide access for the purposes of maintenance, construction or other
service, easements shall be provided for poles, wires, conduits, storm sewers, sanitary
sewers, water lines, open drainage, floodplains, gas lines or other utilities. Such
easements may be required across parts of lots, including rear and side lot lines, where
alleys are not provided.
8. 15’ utility easements will be required for water and sewer extensions to the building
structure.
9. Describe what size water meter will be used for the development.
10. Parking will be calculated for each use according to City of Sanger Parking standards.

Request is for a Preliminary Plat of 4.084 acres of Lot 1, Block A, Sportsman II prepared by Eikon
submitted on 6/12/2019.
The City of Sanger Engineering Department has the following comments that should be addressed prior
to recommendation to City Council for approval:
Resubmit the revised plat along with a response letter addressing all comments.
Show existing right‐of‐way width and distance to centerline along Lois Rd.
Label property line/ROW monumentation
Show coordinates 2 corners and notes regarding coordinate system & datum
Linework for curves C1 & C2 not shown.
Provide UE for electric service to transformer. Check with Electric if to building.
Show adjacent utility easements
Prior to Final Plat approval, a determination if additional R.O.W. dedication along IH‐35 NBFR
will be required.
Water Master Plan calls for a 12” Water Main to be placed along IH‐35 NBFR.
o Show installation of 12” water main along IH‐35 NBFR frontage within 15’ water
easement.
o Existing water main to east on Lois is 12”. Provide 12” water main along Lois Rd frontage
in 15’ water easement. Developer shall be refunded the oversize cost of water main
from 8” to 12” diameter.
Sec. 13.102 Main Extensions for Individual Property Owners
(b) Business, Industrial, Commercial, Apartment and Property Owner Other Than Single Family
Residential.
(1) When the owner of an area, lot or tract of land zoned other than single‐family residential seeks
a water or sewer connection and no standard size water mains or sanitary sewers are adjacent to,
upon or span the complete frontage or distance required across the front of said area, lot or tract of
land, the owner shall extend the said water main or sanitary sewer from the nearest standard size
existing main, as determined by the utility department. The extension shall be constructed either by
the city at the owner's expense or by the owner and shall be extended across the complete frontage
of said area, lot or tract of land when said main extension is located in a street right‐of‐way, alley or
an existing easement. If an additional easement is necessary to extend the water main or sanitary
sewer across the said lot, area or tract of land, then the owner of the property seeking a connection
shall provide the city with an easement as required by the utility department.

to be on private property along IH‐35 NBFR frontage within a pedestrian access easement.
City Code requires detention. Provide drainage comps and how drainage being addressed.
Informational comments that require no action at this time:
TXDOT will need to approve access location prior to filing of plat and approval to construct drive.
TXDOT permits will be required for any access or construction activity in TXDOT right‐of‐way.
Civil construction plans will be required prior to Final Plat approval.
Public infrastructure is required to be constructed and accepted or a Subdivider’s Agreement
executed prior to filing of Final Plat.
Roadway Impact Fees shall be assessed at time of final plat approval.
Verify landscape 40% of 20% in front yard will be available.
