1. Meeting called to order at 7:00pm.
2. Determine Presence of a Quorum and Seating of Alternates.
3. Conduct a Public Hearing Concerning a Requested Variance to the Required 10-foot Minimum
Side Yard for the Property Located at 725 Chaparral Road (Lot 13, Block E, Ranger Creek Estates
Phase 2), Allowing a 7-foot Side Yard.
Public Hearing Opened at 7:39 pm.
Sandra Howard, Developer, stated they are a small builder who has built several homes in the
neighborhood on Dove Ridge; during her due diligence process she was told by City staff that she could
change the setback if she got it signed off by the developer, Joe Falls, which she did; they put 9' garage
doors in instead of 8' which is why they are needing a variance of about a foot and a half.
Larry Peoples, 719 Chaparral, stated all other builders had to comply with the setbacks and does not want
to see the setback changed.
Jim Wiggins, 723 Chaparral, opposed the variance because they need to follow the rules.
David Clark, 731 Chaparral, opposed the variance setbacks because there are rules in place that everyone
needs to follow and understands that Mrs. Howard was a victim of bad advice from an employee that is
no longer employed by the City; wants to keep the original lot size in place.
Stepanie Wiggins, 723 Chaparral, stated if the variance were allowed there would be a precedence set and
there are a lot of lots left in the development.
Stephen Giles, 123 S. 2nd St., stated he is a fireman and that he opposed the variance because the houses
are already too close together and the fire hydrants are not the best working in the development.
Corey Kindle, 725 LaPaloma, stated that everyone has built by these standards and the setbacks are there
for a reason; some of the other homeowners asked for a variance and were told no, so it would not be fair
if Mrs. Howard were allowed a variance.
Public Hearing Closed at 7:57 pm.
4. Consider, Discuss, and Possibly Act on a Requested Variance to the Required 10-foot Minimum
Side Yard for the Property Located at 725 Chaparral Road (Lot 13, Block E, Ranger Creek
Estates), Allowing a 7-foot Side Yard.
Motion to deny the variance was made by Kelly Morgan with a second by Justin Allen. Motion carried
with a four person majority vote. Sherri McCandless abstained from the vote.

Request: Consider, Discuss and Act on a Request for Variance to the Required 20-
Foot Minimum Side Yard for the Property Located at 609 loth Street,
Allowing a 16-Foot Side Yard.

Case Overview
The subject property is located at 609 loth Street and is currently vacant. The applicant's intent is
to build a single-family residential dwelling on this lot. The current zoning is Single -Family
Residential District 10 (SF-10). The minimum side yard adjacent to the street is 20 feet.
The applicant is requesting a 4-foot variance to the 20-foot minimum side yard requirement in
order to accommodate a two-story house (1,650 sq. ft.).
Required Findings
In order to grant the requested variance, the Board of Adjustment must make the following findings or
conclusions:
(i) that special conditions and circumstances exist which are peculiar to the land, structure
or building involved and which are not applicable to other lands, structures, or buildings in the
same district;
(ii) that literal interpretation of the provisions of this ordinance would deprive the applicant
of rights commonly enjoyed by other properties in the same district under the terms of this
ordinance;
(iii) that the special conditions and circumstances do not result from the actions of the
applicant;
(iv) that granting the variance requested will not confer on the applicant any special privilege
that is denied by this ordnance to other lands, structures or buildings in the same district; and
(v) no non -conforming use of neighboring lands, structures, or buildings in the same district
and no permitted use of lands, structures, or buildings in other districts shall be considered
grounds for the issuance of a variance.
The applicant is responsible for demonstrating how their request complies with each of these
requirements.
Notification Response Form
Staff mailed twenty-five (25) public hearing notices to the owners of properties within 200 feet of
the subject property. There were no response forms returned at the time of this report.
Possible Board Action
The Board of Adjustment can adopt the required findings listed above and grant the requested variance.

I am requesting a variance on the property at 609 S loth St, Sanger TX. The property is on
the corner of loth St and Austin St.
I am requesting a reduction in the 20' corner lot/side yard set back on the east side of the
property. I would like to attain an additional 4' of space on the east side of the building
envelope (reducing it to 16' instead of 20'). It is my intention to construct a 2 story home
that is aprox 1650sgft. I think this is the best overall use of the property and will best suit
the overall neighborhood, area and city. I also think it is worth mentioning that I have
proven to build very nice looking homes — many are within the city of Sanger and around the
Denton County area. Most of which are in the range of $35W40kvalue range.
The existing size of the lot, when applying the normal set backs, will not allow to build a
cosmetically appealing and functional home on the site unless there are adjustments to the
building envelope. The previous structure that burned down on the home site, years ago,
appeared to have been a modular home which would not be an option, nor would it be
aesthetically optimal for any similar "in town" home site.
I also attached an architectural rendering of the plan that I am patterning after for the new
home.
I feel confident that this would fall within the category of "special conditions" and the
circumstances are not in any way a result of actions of the applicant.
