Scott Hazel stands to speak.  The house next door fits the size we are requesting.  We are asking for 2 ft.  I moved here 12 years ago and love it but it seems like we are running into hurdles. Ramie reminds them that there will need to be a garage added to any new home. Hazel brings up they wanted to build something for their son.  Hall states he is not interested in a rental property. Hall says he spoke to Ruby Davis. Sally Amendola stopped him and said she is not her to speak for herself. Close hearing at 7:18 PM McAlister asks why was it denied before. Ramie explains it did not meet the width and BOA did not feel there was a hardship. Matt Fuller explains that the previous meeting Ruby Davis was at the meeting and explained she was very concerned of a fire happening and getting her house because they were close.  He explained he did deny it the first time and will probably deny it again.  The house on Kirkland has a drainage Surles made a motion to approve with 8 ft. set backs. Applicant: Joseph D’Amico ______________________________________________________________________________ Case Overview The subject property is located in PD 09-38-37 (Ranger Creek Estates Phase 2) Zoning District. The applicant is requesting a variance from width requirement of 25 feet, and to allow side yard setback adjacent to the street setback of 15 feet, in order to have enough width of the buildable area to build a custom home that meets the planned development requirements as well as Ranger Creek deed restrictions. With 25 feet of side yard adjacent to street setback, the lot has approximately only 37-foot-wide buildable area. The average house requires on average 40-foot-wide buildable area. Also, the applicant cannot acquire additional property to increase buildable area width as all adjunct property is already developed. Currently, no residential zoning district has a side yard adjacent to the street requirement of 15 feet. All the SF zoning districts require minimum 20 feet of side yard adjacent to the street, while most of the R zoning districts require minimum 10 feet of side yard adjacent to the street. The site does have 21 foot of public utility easement along Ranger Creek Road. Staff will not allow any structure construction within the existing 21-foot utility easement, unless the existing utilities are relocated through approval of all utility companies, and the utility easement width is reduced. We have received no response at the time of this report. Staff Recommendation The proposed variance application proves an unnecessary hardship. An unnecessary hardship is defined as: 1. Special conditions and circumstances exist, that are not contrary to the public interest, and which are peculiar to the land, structure or building involved and which are not applicable to other lands, structures, or buildings in the same district; 2. That literal interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this ordinance; 3. That the special conditions and circumstances do not result from the actions of the applicant; 4. That granting the variance request will not confer on the applicant any special privi lege that is denied by this ordinance to properties, structures, or buildings in the same district; 5. No non- conforming use of neighboring lands, structures, or buildings in the same district and no permitted use of lands, structures, or buildings in other districts shall be considered grounds for the issuance of a variance; and 6. Financial hardship shall not be considered grounds for the issuance of a variance. Staff has found that a special condition exists, that is not contrary to the public interest, and which is peculiar to the land, structure or building involved and which are not applicable to other lands, structures, or buildings in the same district, staff determines 25-foot setback adjacent to the street to be a hardship. Staff recommends APPROVAL WITH A CONDITION that the utility easement width is reduced and the site is replatted to show the reduced utility easement width. Actions for Zoning Board of Adjustment The Zoning Board of Adjustment should approve the requested variance from zoning regulations if it finds it to be in conformance with Section 41 (Zoning Board of Adjustment) of the City of Sanger Code of Ordinances, Chapter 14 – Planning and Zoning, Exhibit A – Zoning Ordinance of the City of Sanger Texas.
