05-07-05-Ordinance-Amending the Zoning adding Special Conditions for Lake Ridge Estates Planned Development-06/06/2005ORDINANCE #05-07-05 AN ORDINANCE OF THE CITY OF SANGER, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE BY AMENDING THE SPECIAL CONDITIONS FOR LAKE RIDGE ESTATES PLANNED DEVELOPMENT GRANTED BY ORDINANCE #09-29-03 TO PROVIDE REAR YARD SETBACKS FOR SINGLE FAMILY LOTS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a Request for Change in Zoning Classification was duly filed with the City of Sanger, Texas, concerning the hereinafter described property; WHEREAS, due notice of a hearing was made in the time and manner prescribed by law and the P1amling and Zoning Commission of the City of Sanger, Texas, duly convened and conducted a public hearing for the purpose of assessing a zoning classification change on the hereinafter described property located in the City of Sanger, Texas; and WHEREAS, an additional opportunity for all interested persons to be heard was provided by the City Council of the City of Sanger, Texas, at an open meeting, with proper notice given; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: Section 1. That the Planned Development District for Lake Ridge Estates, as granted by Ordinance #09-29-03, is amended in part by amending the Special Conditions to provide under "Allowable Uses and Sizes" that in a single family district, a minimum rear yard of twenty feet (20') shall be provided, except on lots less than 110 feet in depth the rear yard shall be a minimum of fifteen feet (15'). Section 2. Except as specifically provided in this ordinance, the Special Conditions and other provisions of Ordinance #09-29-03 granting the Planned Development District for Lake Ridge Estates shall remain in full force and effect. Section 3. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Section 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, phrases and words of this ordinance are severable and, if any word, phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining portions of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional word, phrase, clause, sentence, paragraph, or section. Section 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Sanger, and upon conviction shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and each and every day such violation shall continue shall be deemed to constitute a separate offense. Section 6. This ordinance will take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide.
