06/17/2019-CC-Minutes-RegularCITY OF SANGER, TEXAS MINUTES: REGULAR CITY COUNCIL MEETING June 17, 2019, 7:00 p.m. 502 Elm Street, Sanger, Texas COUNCIL MEMBERS PRESENT: Mayor Thomas Muir; Mayor Pro Tem Gary Bilyeu; Councilmember Allen Chick; Councilmember Marissa Barrett; Councilmember Dennis Dillion; Councilmember David Clark. COUNCIL MEMBERS ABSENT: None. The Mayor and all Council Members were present constituting a quorum. STAFF MEMBERS PRESENT: City Manager Alina Ciocan; Director of Development Services Ramie Hammonds; City Planner Muzaib Riaz; City Engineer Tracy LaPiene; Cheryl Price, City Secretary, Josh Bishop, Police Department. 1. Call Meeting to Order, Invocation, Pledge of Allegiance. 2. CITIZEN INPUT: (Citizens are allowed 3 minutes to speak. The City Council is unable to respond or discuss any issues brought up during this section.) 3. CONSENT AGENDA: a. Approval of Minutes 1. City Council Work Session Minutes for June 3, 2019 2. City Council Regular Meeting Minutes May 20, 2019 A motion was made by Mayor Pro Tern Bilyeu to approve the Consent Agenda as presented. The motion was seconded by Councilmember Clark. The motion carried unanimously (5-0 vote). 4. Consider Any Items Removed from Consent Agenda. No items were removed from the Consent Agenda. REGULAR AGENDA Mayor Muir Changed the Order of the two Regular Agenda Items. Bringing forward Item 46 first and then Item #5. 6. (ORDER OF AGENDA CHANGED - SEE ITEM 5 BELOW) Consider, Discuss and Act on Resolution to Authorize the Execution of a Deed Without Warranty to the Sanger Independent School District for the Purchase Price of $100,000 for a Certain Parcel of Land Being 2.64 Acres Out of Abstract 1241 of the Tierwester Survey, Tract 163, Old DCAD Tract 59, Sheet 4, City of Sanger, Denton County, Texas. City Manager Alina Ciocan summarized. This property is involved in a tax suit and was offered for sale by the tax office. There were no bids on the property. The School District made an offer to purchase the property for $100,000. The Resolution that is attached in the agenda packet details the amount of taxes that is owed to each jurisdiction. The City of Sanger is owed approximately $50,000. If the transaction is approved the City of Sanger would recover about $24,000. Denton County will be voting on it tomorrow and all parties have to consent. Mr. Craig Morton with McCreary, Veselka, Bragg & Allen, P.C. representing Denton County, the City of Sanger and Sanger ISD in collections or property taxes. He noted he is present at the meeting tonight as a resource for information. He provided a history of the property and he advised that there have been no taxes collected on this account since 1987. The property is located adjacent to the school district property and they would like to have it for future expansion. In order to collect less than the taxes owed all owners have to consent. Mayor Muir noted it could be a valuable piece of property (the Appraisal District has it valued at $345,000); however, no one has bid on it and it is adjacent to the school property which may limit development. It was noted that it is a really good deal, and the City wants to be a partner with the school. If it was any other entity that there may be concern as to the price. It is a vacant piece of property; the school district has been mowing it and there has been no income from the property for several years (since 1987). There was miscellaneous discussion. It was noted that the School Board has passed it and tomorrow the County votes. (ORDER OF AGENDA CHANGED - SEE ITEM 6 ABOVE) Presentation by Ms. Sharon Pereira Regarding Concern About the Property at 301 E. Willow Street, Sanger, Texas. Ms. Sharon Pereira, 301 E. Willow Street, Sanger, Texas was recognized. She noted that she had written a letter to request to speak to the City Council. She is very concerned that she has found out from her niece that her property flooded a few years ago. She noted that at that time she was not at the property at that time. If it is happening more than once every few years that she should be concerned. Ms. Pereira noted that her mother used to come to the City Council Meetings also and the creek bed was taking her land and that is when the City installed the drainage infrastructure that is there now. Tracy LaPiene City Engineer was recognized and noted that it was a significant very large event with the intensity that it came down and the sheer volume. The City could look at the area with a smaller rain event. He noted the homes are set lower than the road and it did look like they were draining after the event. There was lengthy discussion. Ms. Pereira noted that this is a concern not only for her but for the community. The road was flooded and no one could get anywhere and she would like to be able to get out of the area if she could drive out of it. She is concerned regarding her mother being in the house with dementia by herself, if it happens again. She noted that she would have to get flood insurance now, but that she really does not want to live like this. Mayor Muir concluded that there are areas all over the City that had the same situation. He noted that staff has been tasked to take a look at this situation and the City Engineer will look into it to see if there are any feasible options to improve the drainage. There was additional discussion as to how much water it was and how fast it was moving; and, how the current drainage in the area handled it. It was noted that there are some hard decisions to be made perhaps a long-term plan. Ms. Pereira asked if she could be updated on any status regarding this, that anything would help. Mayor Muir noted that staff would keep her updated. concerns. 7. INFORMATION ITEMS: a. April 30, 2019 Monthly Financial Report b. Capital Projects Recap — June 5, 2019 c. Month of May 2019 Disbursements d. Update to Atmos Energy Rate Schedules R, Cl, T and WNA Tariff. e. ATMOS Energy Rider GCR — Rate Filing Under Docket No. 10170. No comments on the Information Items. 8. FUTURE AGENDA ITEMS: (The purpose of this item is to allow the Mayor and members of Council to bring forward items the wish to discuss at a future meeting. A Council Member may inquire about a subject for which notice has not been given. A statement of specific factual information or the recitation of existing policy may be given. Any deliberation shall be limited to a proposal to place the subject on an agenda for a subsequent meeting. Items maybe place on a future meeting agenda with a consensus of the Council or at the call of the Mayor). There was a request from Mayor Pro Tern Bilyeu to have a future joint meeting with the Planning and Zoning Commission and Zoning Board of Adjustment. 9. ADJOURN.
