Date & Time U r XAB MINUTES: City Council Meeting August 1, 1994 MEMBERS PRESENT: Mayor Nel Armstrong, Councilman Jack Richardson, Councilman Jerry Jenkins and Councilman Tommy Kincaid MEMBERS ABSENT: Councilwoman Margie Braxton and Councilman Joe Bell OTHERS PRESENT: City Administrator John Hamilton, City Secretary Rosalie Chavez, Electric Superintendent Larry Yoast, Chief of Police Benny Erwin, Public Works Superintendent Chuck Tucker, Lisa Hardy - Sanger Courier, Rick Vaughnand Floyd Cunningham - Lone Star Gas Company 1. Mayor Armstrong called the meeting to order. Councilman Kincaid gave the invocation which was followed by the pledge to the flag. 2. CONSENT AGENDA a}. Approve Minutes b}. Disbursements Motion was made by Councilman Jenkins to accept Consent Agenda. Seconded by Councilman Kincaid. Motion carried. 3. Citizen's Input -None 4. Request from Citizens on 1st Street Regarding Drainage Problem Ms. Isabell fialley at 993 First Street addressed City Council regarding a drainage problem she has had for years. Ms. Talley stated that when it rains it causes her to have to park out an the street since her driveway gets flooded. Ms. fialley stated her driveway is hollow due to the drainage problem in her area. Discussion. Mayor Armstrong advised Ms. Talley that they could get the City Engineer to look into the problem to see what the City could do to correct the problem. Staff advised the engineer was scheduled to be here early part of next week and they will get him to look at the problem and make his recommendations. Staff to advise City Council when it is corrected. CC MINUTES PAGE 2, S/ 1/94 5. Consider and Possible Action Regarding Demolition of Buildings at New Library Site Mayor Armstrong stated Mr. Bohman has proposed to remove the old buildings at the new Library Site. Discussion regarding cost. Motion was made by Councilman Jenkins to remove the old buildings at the old buildings for a fee not to exceed $7,500.00. Seconded Richardson. Motion carried. allow Mr. Bohman to at the new Library Site by Councilman 6. (7}. Consider and Passible Action Regarding Ordinance #019-94 - Franchise Agreement Lone Star Gas Company CITY OF BANGER, TEXAS ORDINANCE #019-94 AN ORDINANCE GRANTING TO LONE STAR GAS COMPANY, A DIVISION OF ENSERCH CORPORATION, A CORPORATION, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE TO FURNISH AND SUPPLY GAS TO THE GENERAL PUBLIC IN THE CITY OF SANGER, DENTON COUNTY, TEXAS, FOR THE TRANSPORTING, DELIVERY, SALE, AND DISTRIBUTION OF GAS IN, OUT OF, AND THROUGH SAID MUNICIPALITY FOR ALL PURPOSES; PROVIDING FOR THE PAYMENT OF A FEE OR CHARGE FOR THE USE OF THE STREETS, ALLEYS, AND PUBLIC WAYS; AND PROVIDING THAT IT SHALL BE IN LIEU OF OTHER FEES AND CHARGES, EXCEPTING AD VALOREM TAXES; AND REPEALING ALL PREVIOUS GAS FRANCHISE ORDINANCES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: Motion carried. 7. (6). Consider and Possible Action Regarding Ordinance #07-94 - Hotel Occupancy Tax Discussion. Motion was made by Councilman Jenkins to adopt Ordinance #07-94. Seconded by Councilman Richardson. CC MINUTES PAGE 3, 8/ l/94 CITY OF SANDER, TEXAS ORDINANCE #07-94 AN ORDINANCE OF THE CITY OF SANDER, TEXAS, PROVIDING FOR THE LEVY OF A HOTEL OCCUPANCY TAX TO BE IMPOSED ON CERTAIN BUSINESSES IN THE CITY OF SANGER; ESTABLISHING THE RATE OF SUCH TAX AND EXCEPTIONS THERETO; PROVIDING FOR THE COLLECTION OF THE TAX. AND REQUIRING THE FILING OF QUARTERLY REPORTS; ESTABLISHING THE AUTHORITY OF THE CITY TO PROMULGATE RULES AND REGULATIONS AND REQUIRING ACCESS TO BOOKS AND RECORDS OF AFFECTED BUSINESSES; ESTABLISHING A LEVEL OF REIMBURSEMENT FOR THE COST OF COLLECTING SUCH TAX, PROVIDING FOR THE FAILURE TO COLLECT SUCH TAX, MAKE REPORTS OR PAY THE TAX, ESTABLISHING APPLICABILITY TO THE EXTRATERRITORIAL JURISDICTION OF THE CITY; ESTABLISHING THE APPLICABILITY OF THE STATE TAX CODE; PROVIDING FOR SEVERABILITY OF THIS ORDINANCE; PROVIDING FOR ANY CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE FOR THIS ORDINANCE. Consider and Possible Action Regarding Texas Community Development Grant Motion was made by Councilman Jenkins that we instruct Governmental Services Agency to apply for the Texas community Development Grant to be estimated at $100,000 with City contributing $15,000. Seconded by Councilman Richardson. Motion carried. 9. City Administration Report City Administrator John Hamilton reported on the following: a). City Administrator reported that as of July 17th, 25 permits for new single family residences have been issued totalling $1,237,543. b}. Also, there was a rumor that the Sullivan Senior Center was to be closed by some State Agency, but the SPAN Agency denied that. CC MINUTES PAGE 4, 8/ 1/94 c). Judith Shearmire, Swimming Pool Manager, has resigned effective August 3rd. Terra DeSpain-Lyon who has served as Judith's assistant will assume the manager's position for the remainder of the days. la. Any Other Such Matters a}. City Secretary discussed customer average billing. Council requested that for the next City Council meeting to try to get an estimate on the program change. b}. Mayor advised Chief Erwin that there are still lots of areas that need to be mowed in town. c}. City Administrator instructed to contact Highway Department to find out when are they going to mow in the City. d}. Councilman Jenkins asked Larry Yoast how far did they get on the repairs on the roof at the Senior Center completed. Larry Yoast stated that they did as much as could be done. He also stated that every time there is high temperatures and sun, it will dry out the roof which causes it to leak. 11. Meeting adjourned. Mayor Armstrong called the meeting to order. 2. Discussion -Proposed 94/95 Budget -Public Works' Departments Discussion proceeded with Public Works Departments. The following line item expenses were discussed on the following departments: Wastewater Collection -City Administrator explained that one employee will be budgeted out of Wastewater Collections. Public Works Department's Capital Expense was discussed regarding a new pickup. Line item expense was discussed on Pagers. Parks Department and the Community Center were also discussed briefly. Street Department -Councilman Jenkins asked what is being expensed out of 478.U5 (Other Equipment) since it has na budget amount this year. Staff advised there was probably something expensed out of that line item incorrectly; it will be researched and corrected. Sanitation -Mayor asked Rose to call fiML and ask if our landfill attendant could be classified under another worker's compensation code. CC Workshop Minutes 8/ 1/94, page 2 Listed below are Public Works Departments which will be discussed at the next Budget Workshop. Box 578 Sanger, Texas 76266 Re: Used Oil Recycling Program 'AUG 8 1994 IIVGY RI TF:XA9 You may be aware that new Texas Natural Resource Conservation Commission (TNRCC) rules on the disposal of household used oil are now in effect. In summary, these rules prohibit the dumping of used oil into the waste stream and require that used oil be collected and disposed of by a properly certified waste hauler. In anticipation of these changes, the Denton County Commissioners Court applied for a grant to aid each of the major cities in implementing a used oil recycling program for do-Rt yourselfers. Under the used oil recycling grant, Denton County can provide to each of the participating cities at least one.360 gallon used oil collection container. Some of the larger cities will receive more than one container if the anticipated volume of used oil requires additional containers. On Tuesday, August 2, 1994, the Denton County Commissioners Court approved the attached ICA for the implementation of the used oil recycling program. The ICA details the cities and counties responsibilities for the implementation of this program. If you are interested in participating in this program, please forward this ICA to your point of contact for this project and your city council for approval. With your quick action we can begin placing the used oil receptacles in your cities for use. It is important to note the expiration date on the ICA is August 31, 1994 with certain provisions continuing indefinitely. The TNRCC has verbally confirmed they will be granting an extension of 180 days to our grant. The ICA will be extended by the same amount upon formal confirmation of the TNRCC approval. INTERLOCAL COOPERATION AGREEMENT FOR COLLECTION OF USED OIL THIS AGREEMENT is made and entered into by and between DENTON COUNTY, a political subdivision of Texas, hereinafter referred to as "COUNTY," and the CITY OF BANGER, a municipality of Denton County, Texas, hereinafter referred to as "CITY." WHEREAS, COUNTY is a duly organized political subdivision of the State of Texas engaged in the administration of county government and related services for the benefit of the citizens of Denton County; and WHEREAS, CITY is a duly organized municipality of Denton County, Texas engaged in the provision of services for the benefit of the citizens of Municipality; and WHEREAS, COUNTY has requested and CTMV has agreed to provide used oil collection services for residents of Denton County; and WHEREAS, COUNTY and CITY mutually desire to be subject to the provisions of V.T.C.A., Government Code Chapter'791, the Interlocal Cooperation Act. II. TEXAS WATER COMMISSION CONTRACT This Contract is in furtherance of the Used -Oil Grant Contract No. 3100000141 between the Texas Water Commission (hereinafter "TWC") and Denton County, Texas. TERM OF CONTRACT This Contract begins on the date the parties hereto agree and accept this Contract and terminates August 31, 1994, unless the contract between TWC and COUNTY is extended or unless terminated sooner pursuant to Section II.12 in Attachment A. Provisions in Attachment A, Section II. 41 13, 14, 15 and any other sections which by their terms require performance beyond the term of the Contract shall survive the expiration or any other termination of this Contract. IN7ERLOCAL COOPERATION AGA.EEMENT DENTON COUNTY/CITY OF BANGER COLLECTION OF USED OIL E:\C0ra\U9RD-0u.9Dn E Attachment A USED -OIL RECYCLING PROGRAM IMPLEMENTATION TERMS AND CONDITIONS I. RESPONSIBILITY OF COUNTY 1. COUNTY will provide and deliver to the CITY a 360 gallon collection tanks) designed to control and prevent spillage. 2. COUNTY shall assist the CITY in designing the required spill prevention system (berms) and will inspect the system after construction. Tanks will not be delivered until satisfactory preparation of the site is completed. 3. COUNTY will provide an approved electronic used -oil device. II. RESPONSIBILITY OF CITY 1. CITY agrees to participate as an owner/operator of a used -oil collection center and to the placement of a 360 gallon tanks) on its property as identified on Exhibit II to Attachment A for the collection, recycling, and reuse of used oil. Placement of the tanks shall be on a concrete or asphalt surface. 2. CITY agrees to be responsible for constructing a berm around the tank and for placement of spill prevention pads for each loading/unloading area where used oil will be poured into or removed from the tank. CITY agrees to contract with a TWC registered hauler/recycler for pick up of used oil in accordance with TWC requirements and 40 CFR 279, Subpart E, "Standards of Used Oil Transportation and Transfer Facilities." 4. Upon execution of this Contract, CITY shall register with the TWC as a collection center for used oil. Thereafter, CITY shall maintain registration with the TWC on an annual basis and as long thereafter as the facility continues to accept used oil. CITY shall be responsible for all reports including the annual report to the TWC. Proof of registration must be provided to COUNTY prior to delivery of tanks or acceptance of used oil. 5. CITY shall keep records of all used oil picked up by the hauler/recycler for recycling including the date and amount of each pick-up. Pick-up records should be acknowledged by the hauler/recycler prior to shipment off -site and CITY shall be responsible for manifesting the used oil at the time of pick-up. 6. CITY shall require the hauler/recycler to conduct a halogen test of the used oil prior to pick-up of the used oil by the hauler/recycler. 7. CITY shall conduct an educational and outreach program for citizens by informing them through newspaper advertisements and brochures about the hazards of used oil. 8. CITY should follow the procedures attached as Exhibit 1 to this Attachment A in order to safeguard the collection site and IN'IERLOCAL COOPERATION AGREEMENT DENTON COUNTY/CITY OF BANGER COLLECTION OF USED OIL E:\comr\usED-oa.Dry 0 prevent spillage and the disposal of hazardous, incompatible or improper materials. CITY may adopt procedures more stringent than the procedures provided herein. 9. NOTE: The TWC may allow reimbursement to the owner or operator of a collection center who, in good faith, accepts used oil which is later discovered to be contaminated by a hazardous material. Failure to follow the procedures set out in this contract may disqualify the owner/operator (CITY) from reimbursement of disposal costs. However, COUNTY makes no warranty that compliance with the procedures established in this Contract are sufficient to guarantee reimbursement to the CITY. CITY should consult with TWC prior to handling and disposing of any used oil believed, or suspected, to contain hazardous materials. 10. Title to the used -oil tanks delivered to CITY shall vest with CITY upon delivery. However, if this Contract is terminated prior to its expiration by COUNTY or the TWC due to failure by the CITY to fulfill its obligations, title and physical possession of all tanks and any other associated equipment shall, upon written notification and request by COUNTY or the TWC, be transferred in good condition and within five (5) working days to COUNTY, the TWC or other designated party. 11. CITY shall manage the collection of all used oil in compliance with this Contract and with all applicable federal, state, or local statutes, laws, rules, or ordinances. CITY shall be solely responsible and liable for any and all loss or damages to persons, property, or the environment, including damages to COUNTY or to the TWC, including reasonable attorneys fees and court costs caused or occasioned by the CITY's performance under this Contract or operation of the used oil collection center. CITY agrees to indemnify, to the extent permitted by law, and hold harmless COUNTY and the TWC, their officers, directors, or employees against any and all liability, loss or damages arising out of or incident to CITY's operation of the used oil collection activities, the use of the equipment or any other activity related to any of the services described in this Contract. CITY shall notify COUNTY immediately of any on -site or off -site spill, leak, or release associated with the used oil collection activities. 13. In the event of a default by CITY in the performance of any obligation required by this Contract, or by law, COUNTY may in its sole discretion take over the performance of the obligation and/or may terminate the Contract in whole or in part. In no event, shall the performance of COUNTY of any obligation of CITY be construed to relieve CITY of any obligation under this Contract or from any obligation established by law and CITY agrees to reimburse COUNTY for any expenses incurred by COUNTY to remedy the default of CITY. The obligations of CITY described in this Contract are in addition to any other applicable legal obligations, whether express or implied. D. This Contract, Attachment A, Exhibit 1 to Attachment A, Exhibit 2 to Attachment A and Attachment B represent the entire Contract between the contracting parties and supersedes any and all prior contracts between the parties, whether written or oral. 17. If any provision of this Contract is held invalid, such invalidity shall not affect any other provision which can be given effect without the invalid provision, and to this end, the i sions of this Contract are declared to be severable prov. CITY shall register its facility with the TWC and maintain such registration throughout its waste oil collection activities. 2. CITY shall post hours of operation when used -oil shall be collected at the site. Used -oil shall not be collected at any other t.Lmes. All tanks shall be secured and locked after posted hours and when used -oil collection is not occurring. 3. Used -oil shall not be accepted in amounts greater than five (5) gallons from any one person at any one time. 4. Each container of used -oil shall be examined and tested if contaminates are suspected before placing the used -oil into the used -oil tank. 5. Documentation and logs shall be maintained at all times which lists the name, address, approximate amounts of used -oil brought to the collection center, the date and time of collection for each individual that contributes used -oil to the collection center. 6. Used -oil shall only be accepted from a member of the general public. Used -oil may not be accepted if generated in a commercial or industrial process. 7. Contributors should be questioned as to the process which created the oil before accepting the oil and placing it in the tank. Under no circumstance should used -oil be accepted if it has been contaminated or commingled with any other substances. CITY should not accept any oil that has a cleaning solvent, antifreeze or transmission fluid smell. 9. CITY shall notify the COUNTY immediately if used -oil is discovered to be contaminated after it is placed in the tank. No additional oil shall be accepted until the nature and extent of the contamination is determined. CITY shall be responsible for testing the oil to determine if a hazardous substance has contaminated the oil and shall thereafter be solely responsible for contracting for the disposal and for manifesting the contaminated oil in accordance with all applicable legal requirements. CITY shall be responsible for seeking reimbursement from the TWC. 10. CITY shall utilize good housekeeping procedures, regularly inspect the tanks, label the tanks USED -OIL ONLY, and ensure that the public does not have unsupervised access to the tanks at any time. 11. CITY shall ensure that all tank gauges, containment devices, including tank pipes and containers used for collection or storage are inspected at least once a week and are functioning properly. Oil levels should be recorded daily. Records of such inspections should be kept with records of collection activities for that week. 12. Routine clean-up and replacement of absorbent material around and under the tanks should be performed and such materials disposed of in accordance with TWC requirements. A plan containing emergency procedures should be prepared and retained on -site which describes the actions facility personnel should take in response to vandalism, theft, fires, explosions, or any release of used -oil. Audits conducted pursuant to this Contract shall be in accordance with generally accepted auditing standards and established procedures and guidelines of the reviewing or auditing agency. 4. Where the audit concerns the CITY, the TWC or the COUNTY will afford the CITY an opportunity for an audit exit conference and an opportunity to comment on the pertinent portions of the draft audit report. The final audit report will include the written comments, if any, of the audited parties. 5. Access to records is not limited to the required retention periods. The rights of access sections apply to financial records pertaining to all subcontracts and all subcontract change orders and subcontract amendments. 8. The TWC and COUNTY reserve the right to require the reimbursement of any over -payments determined as a result of any audit or inspection of records kept by the CITY on work performed under this Contract. 9. CITY agrees that in the performance of this Contract, it will not discriminate against any employee or applicant because of race, religion, color, sex, age, with Executive Order Opportunity," as amended or national origin and it will comply 11 246, entitled "Equal Employment by Executive Order 11375, and as supplemented in Department of Labor Regulations (Title 41 CFR Part 50). CITY assures that no person will, on the grounds of race, creed, color, handicap, national origin, sex, political affiliation or beliefs, be excluded from, be denied the benefit of, or be subject to discrimination under any program or activity funded in whole or part under this Contract. 10. CITY shall comply with all applicable requirements of the INTERLOCAL COOPERATION AGREF.IviF.NT DENTON COUNTY/CITY OF BANGER COLLECTION OF USED OIL E:\CONe\UBEo-oO..DtY 13 Americans With Disabilities Act of 1990, Public Law 101-336, 101st Congress, 2nd Session, 104 Stat. 327 (July 26, 1990). 11. Utilization of Small, Minority, Women's Business and Labor Surplus Area Enterprises: a. In accordance with the TWC policy, CITY agrees that qualified small, minority, and women's businesses and labor surplus area firms shall have the maximum MOracticable opportunity to participate in the performance of work under this Contract. b. In accordance with the TWC policy, CITY agrees that it will attempt to achieve thirty percent (30%) participation by minority and women's enterprises and small business enterprises in work performed for this project. If CITY fails to achieve eight percent (8%) participation over the duration of this project, it will demonstrate in writing that it took the following affirmative action steps: (1) Placed qualified small and minority businesses and women's business enterprises on solicitation lists; (2) Assured that such business enterprises were solicited whenever they were potential sources; (3) Divided total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by such business INTERLOCAL COOPERAT[ON AGREEMENT DENTON COUNTY/CITY OF BANGER COLLECTION OF USED OIL E:\Cora\USEDOD,.Dty m enterprises; (4) Established delivery schedules, where the requirement permitted, which encouraged participation by such business enterprises; (5) Used the services and assistance of the Small Business Administration and the Minority Business Development Agency of the U.S. Department of Commerce; and (6) Required its subcontractors to take the affirmative steps listed in Sections (1) through (5) above in all of its subcontracts that contemplate the letting of lower -tier subcontracts. 12. CITY's failure to comply with the provision of Section 11 shall constitute a default under this Contract. 13. If the CITY first conceives of, actually puts into practice, discovers, invents, or produces any intellectual property during the course of its work under this Contract, it shall report that fact to the TWC and COUNTY. 14. CITY may obtain governmental protection for rights in the intellectual property. However, the TWC reserves a nonexclusive, royalty -free and irrevocable license to use, publish, or reproduce the intellectual property for sale or otherwise, and to authorize others to do so. The TWC also reserves a royalty -free nonexclusive, and irrevocable license to use, publish, or reproduce INTERI,OCAL COOPERATION AGREEMENT DENTON COUNTY/CITY OF BANGER COLLECTION OF USED OIL E:\CON \V8ED-oa.Dry for sale or otherwise, and to authorize others to use, publish, or reproduce, for sale or otherwise (to the extent consistent with the rights of third parties) any intellectual property for which the CITY obtains rights with funds received under this Contract. 15. In performing work under this agreement, CITY shall comply with all laws, rules, and regulations relating to intellectual property, and shall not infringe on any third-party's intellectual property rights. It shall hold the TWC and COUNTY harmless for, and defend and indemnify the TWC and COUNTY against, any claims for infringement related to its work. 16. CITY shall include provisions adequate to effectuate the purposes of this article in all subcontracts under this Contract in the course of which intellectual property may be produced or acquired. 17. All data and other information developed under this Contract shall be furnished to the TWC and COUNTY and shall be public data and information except to the extent that it is exempted from public access by the Texas Open Records Act, Vernon's Tex. Civ. Stat. Ann. Art. 6252-17a ("Act"). Upon termination of this Contract, all data and information shall become the property of the 18. CITY agrees to notify and obtain the verbal approval of the COUNTY prior to releasing any information to the news media regarding the activities being conducted under this Contract. CITY shall, except as otherwise provided in this Contract, be responsible for obtaining any necessary licenses and permits, and for complying with any applicable federal, state, and municipal laws, codes and regulations, in connection with the work required by this Contract. 20. CITY shall follow standards and policies on energy efficiency which are contained in the Texas State Energy Conservation Plan issued in compliance with the Energy Policy and Conservation Act (P.L. 94-163). U. CITY shall acknowledge the financial support of the TWC and COUNTY whenever work, funded, in whole or part by this Contract, is publicized or reported in the news media or publications. All reports and other documents completed as a part of this Contract, other than documents prepared exclusively for internal agency use CITY or within the TWC or COUNTY shall carry the following by notations on the front cover or title page: "PREPARED IN COOPERATION WITH THE TEXAS WATER COMMISSION AND DENTON COUNTY" 22. The provisions of the Uniform Grant and Contract Management Act, TEX GOV'T CODE ANN. §783,001, et. seq. (Vernon, 1992)1•apply to this Contract. Compliance with the conditions and requirements contained therein is necessary for the satisfactory performance of the services and work required under this Contract. Goals & Objectives — The goal of the Texas Community Development Program is the development of viable communities by providing decent housing and a suitable living environment and by expanding economic opportunities, principally for persons of low and moderate income. The objectives of the Texas Community Development Program are: a. To improve public facilities to meet basic human needs, principally for low and moderate income persons. b. To improve housing conditions, principally for persons of low and moderate income; c. To expand economic opportunities by creating or retaining jobs, principally for low and moderate income persons. d. To provide assistance and public facilities to eliminate conditions hazardous to the public health and of an emergency nature. 2. Eligible A�nli.: cants —The eligible applicants under the TCDP are units of local government which is generally limited to cities and counties. 3. Eligible Activities —The primary use of TCDP funds is to benefit persons of low and moderate income. For a complete listing of eligible activities, please see the attached handout. Most Common Projects —Most cities or counties that apply under the TCDP request funds for: Water and Sewer System Improvements (most common) Housing Rehabilitation Street Improvements (few of these are funded these days) Drainage Improvements (few of these are funded these days) It should be emphasized that the state is heavily emphasizing water and sewer projects under the 1994-95 TCDP. Such water and sewer projects that are in violation of TNRCC and EPA standards stand the best chance of funding (e.g. 2" water lines that serve more than 10 connections, treatment systems that cannot meet the permitted effluent standards, leaking sewer mains which have been tested for infiltration/inflow, etc.). 4. This year the Texas Department of Housing &Community Affairs has elected to allow the 1994 competition to determine the applicants that will receive 1994 and 1995 program year funds. This means that once the 1994 competition has been completed, the highest ranked projects will receive grant awards from the 1994 program year allocation until the '94 funds have been exhausted. Then, when 1995 program funds become available (probably in July, 1995), the next applicants in line under the '94 competition will be funded until the '95 funds are exhausted. This means that the region will fund twice the number of applications than normally have been funded under the previous single competitions. t The total amount of funds available under the 1994 Texas Community Development Program is $79,329,420. The six funding categories are. l . Community Development Fund 2. Texas Capital Fund (Economic Development) 3 . Colonia Funds (not eligible to apply for) 4. Planning/Capacity Building Fund 5. Disaster Relief/Urgent Need Fund 6. Young v. ' - Maintenance/repair of existing ground and elevated storage tanks (including interior and exterior painting unless the repair extends the useful life of the tank by at least 10 years). - Improvements made necessary because of poor maintenance or operational practices. - Replacement of minor equipment. - Minor facility repairs. - Any improvements which will result in operations that are not in compliance with applicable state, federal, and local laws and regulations. ELIGIBLE ACTIVITIES — - Rehabilitation activities that address all HUD Section 8 Housing Quality Standards or local code, whichever is more stringent. (Examples include structural repairs, comprehensive weatherization, lead -based paint abatement, heating -ventilation -air conditioning, etc.) INELIGIBLE ACTIVITIES — - Rehabilitation activities which include only cosmetic repairs or which improve only the appearance of the structure without addressing structural and code deficiencies. ELIGIBLE RECIPIENTS — Cities and counties are the eligible applicants for TCDP funds, however they cannot directly administer and finance the construction of affordable new housing under the TCDP. In order to provide an affordable new housing program, TCDP applicants must select, through a request -for -proposals process, an eligible subrecipient neighborhood -based nonprofit organization to operate the program. Eligible "subrecipients", "neighborhood", and "neighborhood -based" are defined below. Eligible "subrecipients" are limited to neighborhood -based nonprofit organizations which have 0 organized to promote community development activities on anot-for-profit basis within a neighborhood. For the organization to be considered as "neighborhood -based", a majority of either its membership, clientele, or governing body must be residents of the neighborhood where the TCDP-assisted activities aze to be carried out. A "neighborhood" is defined as a geographic location within the jurisdiction of a unit of general local government (but not the entire jurisdiction) designated in comprehensive plans, ordinances, or other local documents as a neighborhood, village, or other similar geographical location; or the entire jurisdiction of a unit of general local government which is under 25,000 population. A housing finance corporation is a nonprofit corporation organized to provide affordable housing for the residents of a city, or county, or combinations thereof within a state planning region. The jurisdiction of a housing finance corporation is contiguous with the boundaries of the authorizing city, county, or combination thereof. Therefore, unless the population of the eligible applicant (city or county) is under 25,000 population, a housing finance corporation would not qualify as a "neighborhood -based nonprofit organization" as it would not be organized to promote activities within a neighborhood. However, even if the eligible applicant's population is under 25,000, the housing finance corporation would also still have to meet the definition for an eligible "neighborhood -based" organization outlined above. ELIGIBLE ACTIVITIES -- �. -Combined site acquisition and construction costs aze limited to $40,000 per unit. - Administrative costs by the neighborhood -based nonprofit organization aze limited to ten percent (10%) of the total TCDP funds requested . - New housing construction. Acquisition of sites. Clearance of sites. Site improvements. Payment of "soft costs" such as preliminary surveys/analysis of mazket need, site and utility plans, and application processing fees. - Preliminary cost estimates. - Sketch drawing INELIGIBLE ACTMTIES -- - Construction of tenant occupied units. - Construction of multifamily structures. - Housing rehabilitation on existing structures. - Non-residential property may not be converted to residential use. - Acquisition and conversion of existing structures. - Code enforcement. - Sites located in floodplains. - Properties where cleaz title cannot be secured. - Structures having other conditions which would make acquisition of the property infeasible. - Financing acquisition of properties where a simple buyer/seller transaction (inclusion of a third party) does not exist.. � . - Use of TCDP funds to reimburse new housing applicants for prior debt, acquisition, or other associated costs incurred by applicants prior to contract awazd. - Costs of equipment. - Furnishings. - Other personal property not an integral structural fixture, such as window air conditioners or a washer or dryer. INELIGIBLE ACTIVITIES - Cleaning of lines. - Rehabilitation of lift stations if no expanded capacity is being added to collection or treatment systems. - Replacement of minor equipment. - Minor facility repairs. - Improvements made necessary because of poor maintenance or operational practices. - Any improvements which will result in operations that are not in compliance with applicable state, federal, or local laws and regulations. Cities and counties are the eligible applicants for the TCDP funds and may undertake the eligible activities assisting Public Housing residents through resident management and homeownership, or an eligible applicant may make TCDP funds available to a subrecipient to undertake the activities. Subrecipients may include the Public Housing Authority (PHA), resident management corporation (RMC), resident council (RC) or other qualified nonprofit entity. If the funds are made available to a subrecipient, a written agreement between the grantee and the subrecipient that meets the provisions of 24 CFR 570.503 is required. ELIGIBLE ACTIVITIES -- - Acquisition of properties in whole or in part, and make the properties available to residents of public housing through sale, donation or otherwise. - Acquisition of properties for the purpose of rehabilitation, if the property is then rehabilitated and used or sold for residential purposes. - Financing made available by a grantee to rehabilitate residential property owned by a resident management corporation (RMC) or resident council(RC). - Rehabilitation financing made available by a grantee, RMC or RC to new owners of public housing units acquired under above eligible activities. - Grantees may provide funds to eligible subrecipients for housing resident management educational and training programs designed to assist residents in understanding the ownership mechanism and their responsibilities as owners or tenants. - Grantees may make funds available to an RMC or RC for self-sufficiency programs designed to enhance the residents' quality of life, including, but not limited to security, child care, recreational and youth sports programs, health and nutrition, welfare reform initiatives, and demonstration projects. - Public facilities and improvements needed to support the public housing project's viability, such as community centers, playgrounds, and recreational facilities. a INELIGIBLE ACTIVITIES -- - Payment of expenses already financed through another source. As an example, if HUD is already paying the PHA or RMC to manage or rehabilitate a building, TCDP funds may not be obligated to pay the same expenses. ELIGIBLE ACTIVITIES -- - All such activities that provide handicapped access to the facility. - Sheltered workshops for the handicapped. INELIGIBLE ACTIVITIES -- - Area -wide handicapped accessibility activities that do not provide complete access, and benefit the applicant's entire jurisdiction, or are unrelated to providing such accessibility. ELIGIBLE ACTIVITIES -Construction of roadways at new locations, regardless of surface materials to be used. - Construction of added width capacity in the form of additional lanes (not less than 10 feet of added width). . - Acquisition of additional rights -of --way for construction at new locations or for added width capacity. - Projects that increase the structural strength of the roadway or improve service of the roadway. Generally, this refers to improvements in the surface material quality. (e.g., caliche to crushed rock, crushed rock to asphalt, etc.). - Bridge/Culvert Replacement (where deteriorated or obsolete). - Curb and gutter when done in conjunction with other eligible street activities (Note: The TCDP considers curb and gutter, when eligible, to be a street improvements activity and not a drainage improvements activity). SECTION II Failure to comply with any section or provision of this Ordinance that is prohibited or is declared to be unlawful or a misdemeanor, or whenever in this Ordinance, the commission of an act is required or the omission thereof is prohibited, the violation of such provision shall be punishable by a fine not to exceed One Thousand Dollars ($1,000.00); provided however, that no penalty shall be greater or less than the penalty provided under the laws of the State of Texas. Each day any violation of this Ordinance shall continue shall constitute a separate offense. All Ordinances or parts of Ordinances in conflict herewith are to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. I recently attended a workshop sponsored by the Texas Department of Housing and .Community Affairs regarding the HOME Program in Garland, Texas. At this workshop, I was informed that Texas Department of Housing and Community Affairs will be sending out contracts sometime this month. This contract will be between your city and the Texas Department of Housing and Community Affairs. The contract will specify program and special conditions that must be adhered to during the implementation of the grant program as well as the scope of work which must be carried out. Upon receipt of this contract, please forward a copy of the contract to my office so that 1 can compare it with your application to make sure there are no inconsistencies. After receiving the contract, I will forward you an agreement for our grant administration services for your project. I do not wish for your city to obligate any funds until a contract is in -hand from the state. The fees for our services will be paid by the grant program and were included in the application.
