BOX 578 SANGER, TEXAS 76266 MEMORANDUM TO: John Hamilton, City Administrator FROM: Rosalie Chavez, City Secretary f, DATE: March 11, 1994 SUBJECT: Average Billing Program I checked with the City of Denton and Denton County Electric Coop. regarding their Average Billing Program. Lawanna, with the City of Denton, told me that presently they have 908 customers on the program. As far as it having an impact on their cash flow, she stated that it depends on the time of the year they sign on. For instance, if they apply and get on the program in the Spring or Fall, the City is basically running with the customer's money. They use eleven (11) months for their calculations and this will hopefully make their last payment less (their settle -up month.) Their criteria in allowing a customer to get on the program is basically what we are considering: 1). Excellent credit. 2). All accounts must have 12 months prior billing history; however, people with less than a year are at a risk. 3). Customers must be educated to understand that they still have to economize and be conservative; otherwise, their settle -up month becomes a strain to their pocket -book. 4). If a customer has a extreme high bill to settle, they advise them ahead of time to prepare them. 5). Customers on the program are not allowed to pay late or they come off the program. Vickie at Denton County Electric Coop. advised they have 10°Jo of 32,000 accounts on the program and she said there is no impact either as a + or on their cash flow. They allow a customer to get on the program, even with little as three months billing history, with it being monitored monthly. If their customers become delinquent on the program, they are sent a letter, and if it continues, they are removed from the program and cannot requalify until a year has lapsed to monitor payment history. Average Billing Page 2 Denton County Electric Coops does not offer the program to customers who have had any delinquent payments. In talking to Dennis, he advised that our system can handle the change; however, I would like for you to consider the following. 1}. I want to move those accounts in average billing to a statement; not postcards, this will allow more information on the bill. We can revise a bill as to the customer's running total whether it is a negative or plus concerning their bill. It will save us money if we continue with our regular postcards and statements. The reason I don't want to go with statements on all our accounts is the cost, the time to take to stuff 2400 accounts into envelopes and the postage increase; however, if you want to consider all our accounts to be on a full statement, it can be done. 2). I want to eliminate the delinquent notice informing the customer of the disconnect and provide that information on the original statements however, it would be difficult to put that information on the postcard. 3). The postage of course will go up from 19 to 29 which will be an increase; however, if we eliminate the disconnect notice this could help compensation somewhat. 4}. I also agree with the City of Denton that if the customer signs up in the Spring or Fall, it is to our advantage since we will actually be using more of their money in months where their bills would be less. 5). I also think if a customer has the advantage to see how much his bill is on a monthly basis it will enlighten him to be conservative and to monitor his usage. 6). I also think we should average the bills on 11 months based on 12 months billing history. 7). Customer must also sign an equal payment authorization. As to your question regarding Lone Star Gas Company's billing which adjusts monthly based on an eleven month's prior average, yes our computer can handle this with a program change. RC: es CITY OF SANGER, TEXAS ORDINANCE NO. 02-94 AN ORDINANCE OF THE CITY OF SANGER, TEXAS, AMENDING TI-IE CODE OF ORDINANCES OF THE CITY OF SANGER BY ADUY1'ING AN EQUAL PAYMENT PLAN FOR THE PAYMENT OF ELECTRICITY BILLS; PROVIDING FOR SEVERABILITY OF THIS ORDINANCE; PROVIDING I+'OR ANY CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE FOR THIS ORDINANCE. NOW BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER: 1 �1 i 1,) �:► Ott_ 1 1 (a) That from and after the effective date of this ordinance, the City of Sanger Code of • Ordinances shall be amended to include Article 11.1600.5 to read as follows: "ARTICLE 11.1600.5 (1) Qualified customers of electrical service may enroll in a plan designed to provide equal utility bills throughout the year, such plan to be lrnown as the "Equal Payment Plan." (2) Electricity usage will be estimated by the City of Sanger Utilities in order to determine the amount of the equal monthly payment. Estimates will be made based primarily on past usage by the customer at the present address. Said payment shall be made monthly, subject only to changes in the twelfth month or due to rate adjustments, as provided for herein. (b) Twelfth Month Aduustments. Equal payments shall be made for eleven (11) months. In the twelfth month, any difference between the estimated amount and the actual month shall be settled. If monthly payments are less than the charges for actual use, the twelfth month bill will show the balance due, including this difference. If monthly payments have totalled more that the charges for actual usage, any difference will be refunded to the customer. Payments in first eleven (11) months must be consistently made, regardless of any credit accruing during said eleven (11) months. (c) Plan for Electrical Service Onlv. The equal payment plan is available for the payment of charges for electrical service only. (d) Prerequisites for Participation in Plan. In order to qualify for participation in said plan, potential customers must have an established credit record with the City of Sanger Utilities. The following shall be considered proof of an established credit record as required herein: (i) A minimum of twelve (12) months of timely payment of utility charges; Page 1 of 2 j--,...� Absence of months; and any utility service termination in the past twelve (12) (iii) Absence of anoutstanding balance with the City of Sanger Utilities. (e) Application. Customers interested in participation in the equal payment plan must apply by completing an application form as maintained on file in the office of the city secretary. Said application shall be subject to review and denial or approval by the City of Sanger Utilities (f) Effect of Rate Adjustments. Any rate adjustments imposed during the normal course of business by the City of Sanger Utilities shall be included in the average bill as they become effective." SECTION II: SEVERABILITY That if any section, subsection, paragraph, sentence, clause, phrase, or word in this Ordinance, or application thereof to any person or circumstances, is held invalid by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the Ordinance, and the City Council hereby declares that it would have passed such remaining portions of the Ordinance despite such invalidity. That any and all Ordinances of the City of Sanger heretofore adopted which aze in conflict with this Ordinance are hereby expressly repealed insofar as the same are in conflict therewith. SECTION IV: EFFECTIVE DATE That this Ordinance shall take effect immediately, from and after its passage and publication of the caption, as the law in such cases provides. If Council concurs an amendment to the City Cade, it will be prepared for your consideration at the April 4th Meeting. JH:es Enclosures CITY OF SANGER, TEXAS RESOLUTION #R2-94 A RESOLUTION OF,THE CITY COUNCIL OF THE CITY OF SANGER, DENTON COUNTY, TEXAS: WHEREAS, the North Central Texas Council of Governments (NCTCOG) is established to assist local governments in planning for common needs, cooperating for mutual benefit, and coordinating for sound regional development; and, WHEREAS, NCTCOG has been involved for the Bast twenty-six years in municipal construction code activities in the region; and, WHEREAS, NCTCOG recommends a cooperative regional program for the competency testing at various grade levels of electricians desiring to perform electrical work in this region, hereinafter referred to as the North Central Texas Electrical Examination Program; and, WHEREAS, NCTCOG through its Regional Codes Coordinating Committee will select the qualified testing agency to administer the program and provide the examinations; and,. WHEREAS, this program will help protect the health, safety, and welfare of citizens of the City of Sanger as well as the remainder of North Central Texas; and, WHEREAS, this program will remove the burden of local testing of electricians from the City of Sanger as part of its electrician licensing requirements; and, WHEREAS, this program will provide quality testing opportunities that are cost efficient and convenient for prospective electricians in the City of Sanger at their desired grade levels. NOW, THEREFORE, BE IT HEREBY RESOLVED: SECTION 1 That the City of Sanger will participate in a competency testing program far electricians on a regional basis through the North Central Texas Council of Governments. SECTION 2 That the City of Sanger authorizes NCTCOG to execute an interlocal agreement with the other participating jurisdictions and NCTCOG signaling participation in this program. SECTION 3 That the City of Sanger agrees to accept the results of the examinations administered by the approved testing agency through NCTCOG as the applicant's fulfillment of the competency testing component of the City of Sanger electrical license requirements. This resolution shall be in effect immediately upon its adoption on day of . 1994. This modification may impact other items within your electrical license ordinance since it is intended that there will no longer be any pre -qualification of applicants desiring to take the electrical examinations. Also, any accommodation for a special examination will be the sole responsibility of the municipality since such accommodation will not be provided by SBCCIJ Examination Prerequisite to Electrical License Any applicant for an electrical license of any grade shall pass an examination as a precedent to the issuance of such license. Such examination shall be administered by an testing agency through the North Central Texas Council of Governments. THE STATE OF TEXAS THE REGION OF NORTH CENTRAL TEXAS INTERLOCAL AGREEMENT FOR THE TESTING OF ELECTRICIANS THIS INTERLOCAL Agreement ("Agreement") effective is entered into between the city of , a municipal corporation duly incorporated under the Constitution and laws of the State of Texas; the North Central Texas Council of Governments ("NCTCOG"), a political subdivision of the State of Texas acting by and through its Executive Board, and other North Central Texas governmental entities consenting hereto, WITNESSETH WHEREAS, pursuant to the Interlocal Cooperation Act, Texas Government Code, Chapter r91, as amended (the "ACT"), cities, counties, special districts and other legally constituted political subdivisions of the State of Texas are authorized to enter into interlocal contracts and agreements with each other regarding governmental functions and services as set forth in the Act; and, WHEREAS, the parties to this Agreement have been cooperating together through NCTCOG to develop a cooperative regional program to accomplish competency testing of electricians in North Central Texas; and, WHEREAS, other entities will become involved in the regional electrician testing program, hereinafter referred to as the North Central Texas Electrical Examination Program, and benefit from cooperation through this Interlocal Agreement; and, WHEREAS, the parties to this Agreement understand that entering into this Agreement in no way obligates any party to participate in any associated program without the express approval of the party; NOW, THEREFORE, for and in consideration of the promises and the mutual covenants herein contained, and subject to the conditions herein set forth, the parties hereto covenant, agree and bind themselves as follows: ARTICLE 1 -- PURPOSE OF AGREEMENT The purpose of this Agreement includes accomplishing the following objectives: • Protect the health, safety, and welfare of citizens of North Central Texas through a cooperative regional program for the competency testing at various grade levels of electricians desiring to perform electrical work in this region, • Remove the burden of local testing of electricians from municipalities as part of their electrician licensing requirements; • Engage, through the North Central Texas Council of Governments, a qualified testing agency or agencies to prepare, administer, and grade the electrical examinations; and Page 1 of 3 f 3/?194 • Provide quality testing opportunities that are cost efficient and convenient for prospective electricians at their desired grade levels. ARTICLE 2 -- ADMINISTRATIVE AND POLICY STRUCTURE The administrative and policy structure under this Agreement is as follows: • NCTCOG's Regional Codes Coordinating Committee ("RCCC") will approve recommendation of the qualified testing agency or agencies to be used, provide policy guidance for the cooperative program, and make recommendations to the participating entities to accomplish the purposes of this Agreement. • The RCCC will appoint whatever supporting subcommittees it deems necessary and desirable to provide technical guidance and assistance to the selected testing agency or agencies, including a validation task force of representatives from the region. • NCTCOG will be the administrative agent under the Agreement pursuant to the Interlocal Cooperation Act and enter into an agreement on behalf of the participating parties with the selected testing agency or agencies. • The selected testing agency or agencies and its testing program are fiscally supported by the testing fees collected from the applicants. No funds will be solicited from the parties to this agreement or NCTCOG and no party hereto shall be liable or responsible for the payment of funds in support of this regional testing program beyond the testing fees from the applicants. The RCCC will approve the testing fee. • This Agreement is recognized as a supplemental level of service, and is not intended to duplicate or diminish the products, assistance, representation, or services received by participating entities through NCTCOG membership. ARTICLE 3 --ADDITIONAL PARTIES Additional political subdivisions within or serving the North Central Texas region may become parties to this Agreement by approving the terms and conditions of this Agreement and affixing hereto the signature of its authorized representative indicating the date of approval of this Agreement by said entity. This Agreement will be in effect for one year from the effective date of this Agreement, and will be considered automatically renewed for each succeeding year. A party may withdraw from this Agreement provided that it has notified the Executive Director of NCTCOG of such action in writing at least 60 days before its intended withdrawal date. Amendments may be made to this Agreement upon the approval of the affected parties. ARTICLE 5 -- SEVERABILITY CLAUSE If any provision of this Agreement or any application hereof shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions and applications shall not in any way be affected or impaired thereby. Page 2of3 000 30 3/2/94 ARTICLE 6 -- GOVERNING LAW This Agreement shall be construed in accordance with and governed by the laws of the State of Texas. ARTICLE 7 -- INDEMNIFICATION It is agreed that no party to this Agreement shall be responsible for the acts of another party to this Agreement. ARTICLE 8 -- MISCELLANEOUS It is expressly understood and agreed that in the execution of this Agreement, neither the parties to this Agreement nor NCTCOG waive, nor shall be deemed to waive, any immunity or defense that would otherwise be available to each against claims arising in the exercise of governmental powers and functions. The undersigned officers and/or agents are properly authorized to execute this contract on behalf of the parties hereto, and each hereby certifies to the other that any necessary resolutions extending such authority have been duly passed and are now in full force and effect. By entering into this Interlocal Agreement, the parties do not create any obligations, express or implied, other than those set forth herein, and this Agreement shall not create any rights in parties not signatories hereto. Signature Title Agency Date Mike Eastland Executive Director North Central Texas Council of Governments Date Page 3 of 3 3/Z/94 North Central Texas Council Of Governments TO: Building Officials in North Central Texas DATE: March 4, 1994 FROM: Charles Clawson, Chairman NCTCOG's Regional Codes Coordinating Committee SUBJECT: Implementation of the North Central Texas Electrical Examination Program The Regional Codes Coordinating Committee (RCCC), consisting of representation from municipal code administration and the private sector, provides support and advice to the North Central Texas Council of Governments' (NCTCOG's) Executive Board on a wide range of municipal building codes issues. A current issue of concern to the RCCC is the existing burden on municipal staff to be administratively involved with the competency testing of electricians as part of their municipality's electrician licensing requirements. In this day of shrinking budgets and increased workloads, municipalities can no longer afford to bear this responsibility. In an effort to remove this burden and continue to protect the health, safety, and welfare of citizens of North Central Texas, the RCCC- obtained, on January 27, 1994, NCTCOG's Executive Board endorsement of the implementation of a cooperative regional program for the competency testing at various grade levels of electricians desiring to perform electrical work in this region through the attached (blue) resolution. The NCTCOG's Executive Board authorized the engagement of Southern Building Code Congress International, Inc. (SBCCI), a qualified and experienced testing agency, to prepare, administer, and grade the electrical examinations. SBCCI was chosen as the agency to provide the testing services`" after an extensive selection process conducted by RCCC's Electrician Testing Program Task Force, An Agreement will be completed between NCTCOG, on behalf of participating municipalities, and SBCCI, stipulating necessary components of the North Central Texas Electrical Examination Program. Initially, exams for the electrician grade levels of Master Electrician, Journeyman Electrician, Master Sign Electrician, and Maintenance Electrician will be offered at three locations per month; one in the Dallas area, one in the Mid Cities area, and one in the Fort Worth area. Exams for Residential Wireman, Journeyman Sign Electrician, and Elevator Electrician are currently under development and will be offered in the near future. The examination administration process will be the complete responsibility of SBCCI and will be fully financially supported by the testing fee of $45 to be paid by the applicant. There will be no funding or administrative responsibilities expected from participating municipalities. Participating municipalities will agree to accept the exam results from this program. Acceptance of these test results will serve as the applicant's fulfillment of the competency testing component of the municipality's electrician licensing requirements. With the exception of the competency exam, municipalities will retain all other electrician licensing authority and responsibility they currently possess. Municipalities wishing to participate in the program will need to take appropriate action by its governing body and have a duly authorized representative execute and return to NCTCOG the attached interlocal agreement. Model resolution and ordinance language is also attached for the convenience of those municipalities that may need it. Testing is scheduled to begin in April. Therefore, action is needed as soon as possible by those municipalities desiring to participate in the testing program. In about one more year the trees at the Wastewater Treatment Plant tree farm should be large enough to begin transplanting onto city properties. 2}.
