After discussing this with Mayor Armstrong, a brief workshop on this topic will be held at 6:36 p.m., Monday, in the Conference Room to explore options and take direct from Council so that staff may proceed to address possible remedies. Mayor Armstrong called the meeting to order. �. Discussion Regarding Proposed Water/Sewer Bond Projects 3. Discussion Regarding Street Improvement Program 4. Discussion Regarding Sidewalk Improvements After much discussion regarding items #�, #3, and #4, it was the concensus of the Council for Mayor Armstrong to appoint a Citizen Advisory Committee to review the Capital Improvement Projects and make recommendations to the City Council. Staff was also requested to prepare a list of the streets which need I mprovement in priority order. 5. Any Other Such Matters - None 6. Meeting adjourned. Five & Final Payment - All -Tex Paving, Inc. $20o716.30 Motion was made by Councilman Jenkins and seconded by Councilwoman Braxton to approve the Consent Agenda. Motion carried. 3. Citizen's Input - None 4. Consider and Possible Action Regarding Awarding Fire Department Utility Vehicle Bid The following bids were received 1-18-94 at 2:00 p.m.: CUMPANY James Wood GMC Denton, Texas Hilz-Snider Chevrolet Sanger, Texas AMT. BID FOR PROJECT $20,584.40 7.1 °10 36 mom - 63 2.79 48 mom - 490.97 $21,560.24 48 moo - 514.24 CC MINUTES 1/ 18/94, page 2 Motion was made by Councilman Richardson and seconded by Councilman Madden to accept the low bid from James Wood GMC for $20,584.40. Motion carried. 5. Consider and Possible Action Regarding Mobile Home Ordinance - Permit and Bonding Requirements After much discussion, it was the concensus of the City Council that bond requirements will no longer be required for Mobile Home Parks. Motion was made by Councilwoman Braxton and seconded by Councilman Kincaid to amend the City ordinance to eliminate the $25 annual fee, pay only the initial fee. Motion carried. Item will be placed on the February 7th agenda. 6. City Administration Report City Administrator John Hamilton reported on the following items: 1). The proposed library site has been transferred to the City by the Library Development Committee. The $22,311.91 note on the property to Griffin B. Huey has been paid with the Development Board paying $4,599 and the City contributing $17,811.91. All rent proceeds will be transferred to the City into a separate account to accommodate these revenues. 2). The new fire marshall, Bob Hagemann, will begin his duties an February 1, 1994. 3). The new solid waste rates will be reflected on the February 1st billing. 4). The Denton County Democratic Party has requested use of the Council Chambers during the primary election, Tuesday, March 8th from 7 a.m. to 7:45 p.m. If Council has any objections, please let us know. 7. Any Other Such Matters 1). City Administrator mentioned that the Fire Department needs to appoint a City Council member to serve on the Pension Board due to Councilman Jenkins' term has expired. Councilman Jenkins' stated he would be interested in serving again on the Pension Board. CC MINUTES 1J 18/94, page 3 2). Mayor Armstrong mated the letter in the packet from the Texas Department of Transportation mentions that the new spelling of Keaton Road will be replacing the existing highway signs around the middle of February. 3). Mayor Armstrong mentioned that the Sanger Chamber of Commerce Reception is scheduled for January 24, 1994. 4). Mayor Armstrong briefly discussed the residential permits and construction statistics and analysis provided by cities and MP/F Research. 5). It was Hated that the clay has arrived and will be ready to spread at the landfill whenever weather permits. 6). It was briefly discussed that the transition to Texas 't�tTaste Management has been going fairly smooth and that they are beginning trash pickup around 7:3O a.m. 8. Meeting adjourned. JH:es attachment A RESOLUTION TEXAS: RESOLUTION #R1-94 CITY OF SANGER, TEXAS OF THE CITY OF SANDER, DENTON COUNTY, WHEREAS, the Texas Department of Transportation Commission is the three -member governing body of the Texas Department of Transportation which oversees that department along with the executive director of TX DOT; and, WHEREAS, the role of the Texas Department of Transportation is to ensure the quality of highways and roads by working with counties and cities; and, WHEREAS, there is a direct correlation between dollars spent an highways and roads and generating economic development for counties and cities which in turn helps improve the economy of the state; and, WHEREAS, David E. Bernsen, Henry R. Munoz III and Anne S. Wynne have all been duly appointed commissioners of the Texas Transportation Commissioners and William Burnett serves as executive director to the Texas Department of Transportation, and, WHEREAS, in an effort to further a cooperative partnership between Denton County and the Texas Department of Transportation Commission, the City of Sanger encourages the commission members to accept Denton County's invitation to visit Denton County and learn more about transportation accomplishments and needs. NOW THEREFORE, BE IT RESOLVED, that the City of Sanger, Denton County, agrees with Denton County declaring February 169 1994 as Texas Department of Transportation Day in honor of the anticipated visit by commission members to our county, this _ _ day of February, 1994. BOX 578 BANGER, TEXAS 76266 Honorable Mayor & John Hamilton, City February 4, 1994 Water/Sewer Billing Members of the City Council Administrator - Multi -Unit Retail Mr. Jahn Bucklew has requested agenda time to discuss his concern about Multi -Unit Retail water and sewer billing. Currently, the City has no separate code reference for commercial water accounts. Residential and Business water and sewer rates are charged at the same rate except the Class B, business sewer rate minimum is $16.00 per month with a $125 cap. Since the per thousand gallon charges are the same, multi -unit retail businesses such as Mr. Bucklew's Cotton Patch Shopping Center, the Wilfong Building and Mr. Chatfield's strip shopping center are charged minimum bills (water and sewer) for each rented space. This is consistent with the City's policy for master metered residential units such as apartments and Mobile Home Parks. According to staff, this has been City policy for as long as they have been employed. Attached are: 1). Copy of the Water Rate Ordinance used to apply to Retail. 2). A chart comparing water/sewer charges of selected area cities. 3). A summary of Mr. Bucklew's billing at the Cotton Patch Center. NOTE: On January 27th, I had a two hour meeting with John and Mary Bucklew regarding not only the utility charges, but their contention that the Bucklew family has done much for Sanger but that the City has done nothing in return. They wanted to tape record the meeting, but I declined to be recorded until after everything on their agenda had been discussed. They did not ask to record any statements after the meeting. Other items they discussed were: 1). Slow service on a sewer stop -up at their new chapping center. MEMO #2422 2/4/94, page 2 2}. Trouble they have had with the sewer line to their shopping center. The line was bored under the Hillcrest Apartment driveway and has had some problems flowing. Staff thought this had been fixed prior to the holidays. When J. W. Bucklew began working on this project, he was advised that the sewer line would be a "close call" because of the limited fall to the tie-in manhole near Diane Drive. He was advised of the sump pump option and chase to go with a gravity line. 3}. Lack of a specific Commercial Property Building Permit Form. The Bucklew's Project was the first Commercial property constructed since prior to 1988. The City's current Building Permit Application is generic for both residential and commercial. Chuck Tucker is now working on a Specific Commercial Form. 4}. Lack of response to their inquiry as to the type of grease trap required for a food service business. John Bucklew answered this himself, when he told me that he knew the plumbing code would not allow him to install an in4ine collector that he would need an under the sink type trap. He was informed that staff would double check with our contract sanitarian and would in writing inform the Bucklews what was required. John Bucklew implied that they had lost on potential renter, Donut Shop, because of not being able to get an answer from the City, which Chuck Tucker stated to me was not correct. On February 1st, Mary Bucklew telephoned the front office and requested, in writing, a step by step accounting from our Utility Billing Clerk on how their Cottonpatch Center was being billed for water and sewer. (b) That from and after the effective date of this ordinance, Section 3.608(b) of the Code of Ordinances of the City of Sanger, Texas, regarding the required annual renewal of mobile home park permits is hereby repealed. (c) That Section 7.102 of the Fee Schedule found in the Appendix of the Code of Ordinances of the City of Sanger, Texas, is hereby repealed. (d) That Section 7.102 of the Fee Schedule found in the Appendix of the Code of Ordinances of the City of Sanger, Texas, shall hereafter be amended to read "Reserved for Future Use." SECTION II: SEVERABILITY That if any section, subsection, paragraph, sentence, clause, phrase, or word in this Ordinance, or application thereof to any person or circumstances, is held invalid by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the Ordinance, and the City Council hereby declares that it would have passed such remaining portions of the Ordinance despite such invalidity. The District has a contract with the City of Denton, under which we can obtain treated water on the perimeter of Denton's system for delivery to the District's customers. This may be an avenue worth pursuing in this case. This source of water is available on relatively short notice, subject to the time it may take to construct delivery facilities. 2. The District has plans and funding to construct a surtace water supply line along IH-35 to the City of Sanger. Bolivar WSC may want to subscribe to capacity in that line. 3. Before the District can determine the possibility of providing service to a specific part %J the Bolivar WSC system including Green Valley, it seems advisable to develop an understanding of the overall need of the BWSC system for surface water. 4. The District provides water service to utilities who contract to participate in a project of the District and who agree to pay their pro rats share of the project. PREVIOUS AGREEMENTS The existing Agreement for Interchange of Electric Power between Brazos Electric Power Cooperative, Inc. and the City of Sanger, Texas, dated May 3, 1962 and all amendments thereto and the Special Agreement between Brazos Electric Power Cooperative, Inc. and the 4 City of Sanger, Texas, dated May 3, 1962 are superseded and replaced by this agreement. SECTION 2. GENERAL TERMS The Cooperative shall sell and deliver to the City and the City shall purchase and receive from the Cooperative all of the electric power and energy which the City shall require for the operation of the City's system. The City and the Cooperative shall cooperate in preparing load projections, power and energy requirements, planning for new substation facilities to provide firm power to the City and other planning activities required to carry and the Intent of this agreement. The City shall so operate its system as not to cause any violation by the Cooperative of the Cooperative's obligations under any other cooperative mem- ber, interconnection, interchange, power supply or other contract, including without limitation any provisions in such contracts with.respect to excessive demands and voltage fluctuations. 2 CITY SECRETARY ORIGINAL CONY In the event the Cooperative contemplates the removal from service, repair or alteration of any piece of equipment and said removal or alteration or repair affects or may affect the availability of power and energy from the Cooperative or affects or may affect the performance of the City's facilities, the Cooperative shall notify the City at least twenty-four (24) hours in advance of such removal, alteration or repair, if the need for such removal, alteration or repair can reasonably be ascertained by the Cooperative twenty- four (24) hours in advance. In the case of emergencies affecting the facilities the Cooperative, to the extent that the delivery of power and energy to the City is affected, the Cooperative shall immediately notify the City of such emergency, stating its extent and probable duration. Each party shall notify the other party of the proper personnel to be contacted and notified of changes in operation processes and procedures. The procedure for reading and reporting the readings of the meters mea- suring the power and energy delivered and for determining the method of opera- tion between the parties or changes in operation which affect or may affect the operation of the other party's equipment or facilities shall be mutually agreed upon by the parties hereto. SECTION 3. ELECTRICAL CHARACTERISTICS AND DELIVERY POINTS Electric power and energy to be furnished hereunder shall be nominal sixty Hertz alternating current. The Cooperative and the City shall jointly coordinate the making of all final connections between the City's system and the Cooperative's system or another source of electric power and energy pro- vided by the Cooperative at the points) of delivery. The initial point(s) of delivery, delivery voltage and initial capacity shall be as set forth in Schedule A attached hereto and made a part hereof. Other point(s) of delivery and their initial delivery voltage, and capacity may be established by mutual agreement of the City and the Cooperative, and Schedule A shall be revised accordingly. The City shall keep the Cooperative advised concerning anticipated loads at established points) of delive ry and the need for additional points) of delivery by furnishing the Cooperative by September 1 of each year a revised "Schedule B" substantially in the form attached hereto. SECTION 4. FACILITIES AT DELIVERY POINTS The Cooperative shall install, own, and maintain or otherwise provide the necessary substation equipment at the points) of delivery. The Cooperative ahall own and maintain or otherwise provide switching and protective equipment which may be reasonably necessary to enable the City to take and use the elec- tric power and energy hereunder and to protect the system of the Cooperative. The Cooperative shall be responsible for reading meters and for furnishing and maintaining meters and metering equipment, which shall be located at the point(s) of delivery. 3 SECTION 5. RATE CITY SCCRETARY ORIGINAL. COPY The City shall pay the Cooperative for the power and energy received dur- ing each calendar month in accordance with the Cooperative's current tariff, or future changes thereto, which have been approved by the regulatory agencies which approve the Cooperative's tariff. The Cooperative shall provide the City with a copy of the current tariff and future approved changes thereto. Determination of billing for power and energy shall be made by applying said tariff to the power and energy delivered. SECTION 6. METER READINGS, METER TESTING AND BILLING ADJUSTMENTS The Cooperative shall read meters monthly and shall test and calibrate meters by comparision with accurate standards, at intervals of not more than twelve (12) months. The Cooperative shall also make special meter tests at any time at the City's request. The cost of all tests shall be borne by the Cooperative, provided, however, that if any special meter tests made at the City's request shall disclose that the meters are recording accurately, the City shall reimburse the Cooperative for the cost of such test. Meters regis- tering not more than two per cent (2X) 'above or below normal shall be deemed to be accurate. The readings of any meter which shall have been disclosed by test to be inaccurate shall be corrected for the ninety (90) days* •prev`ious to such test in accordance with the percentage of inaccuracy found by such test. If any meter shall fail to register for any period, the amount payable by the City shall be based upon the electric power and energy delivered by the Coop- erative in the corresponding period immediately prior to the failure, unless the City and the Cooperative shall agree on the amount of power furnished dur- ing such period. SECTION 7. NOTICE OF PfETER TEST The Cooperative shall notify the City in advance of the time of any meter test so that the City's representative may be present at such meter test. SECTION 8. RIGHT OF ACCESS Duly authorized representatives of either party hereto shall be permitted to enter the premises of the other party hereto at all reasonable times, in order to carry out the provisions hereof. SECTION 9. CONTINUITY OF SEKVICE The Cooperative shall use reasonable diligence to provide a constant and uninterrupted supply of electric energy, delivered under the terms of this contract. If the supply of electric energy shall fail or be interrupted or become defective through an act of God or of the public enemy or because of accident, failure of facilities, labor trouble or any other cause beyond the control of the Cooperative, the Cooperative shall not be liable for any dam- age. SECTION 10. REQUEST FOR RATE CHANGE EXECUTIVE SUMMARY For the City of Sanger Presented JANUARY 1994 �O 1/19/94 BRAZOS ELECTRIC POWER COOPERATIVE, INC. REQUEST FOR RATE CHANGE FEBRUARY 1994 EXECUTIVE SUMMARY REQUESTED RATES Reasons Because of cost increases since the 1988 test year, which was used as the basis for our last rate reduction, and a need to strengthen our financial posture, Brazos Electric is requesting a rate increase, which we anticipate will be effective in August 1994. The proposed annual revenues of $228 million represent a noticed increase of 8.29 percent, with the increase in base revenues being only 4.23 percent (Exhibit A). Brazos Electric's equity as a percent of assets is about 14 percent. To meet the requirements of REA and private financial markets, we are requesting that our target operating times -interest -earned ratio (TIER) be increased from 1.05 to 1.15 to build our equity percent to 20 percent. The present cost components of the 4.23 percent rate increase are: Net change in operating costs $6.4 million Increase on existing TIER $0.9 million Requested increase in TIER $1.9 million Total $9.2 million A comparison of the requested rate and our current rates is shown in Exhibit B. Exhibit C shows the projected impact on Brazos Electric's wholesale customers. We point out that the percentage impact on a retail consumer will be smaller because not all of his or her electric bill is wholesale power. Time -of -use window We are proposing atime-of-use window of 3 p.m, to 8 p.m. for the on -peak (May through October) coincident peak (CP) because we think it will help customers develop methods to reduce growth of their demand at the time of our peak load and, consequently, help us to reduce the growth of our peak load. The structure of our requested rates maintains the existing relationships of coincident peak demand to power cost recovery factor for demand (CP-PCRFD) and energy to power cost recovery factor for energy (KWH-PCRFE). These relationships tend to stabilize margins because the lower the base rate billing units, the more purchased power cost is recovered, and, conversely, the higher the base rate billing units, the less purchased power cost is recovered. For instance, during the hot summer of 1993, we did not generate significant additional margins. -1- 1/19/94 RATE CHANGE HISTORY Past rate cases Because Brazos Electric is a non-profit organization, we strive to minimize the cost of power to our customers. Consequently, there have been several reductions in our recorded history of rate actions, which are shown in Exhibit D. Savings achieved We emphasize how much we have done for our customers and their consumers over the past ten years. Our average cost of power has declined since 1983 because we have instituted a number of steps to reduce our costs. We took control of our gas supply situation by building to our R. W. Miller Plant a pipeline that paid for itself with fuel cost savings in thirteen months. We made a decision to purchase capacity instead of building generation facilities until we could fully absorb the output of a future unit. We trimmed operating costs and instituted economic dispatch within the Texas Municipal Power Pool. We successfully extricated ourselves from a nuclear project, retrieving 91 cents per dollar invested. And we took many other actions of smaller impact. We feel that the combined effect of our actions has been awesome. From January 1984 through October 1993, we have saved our customers $445 million, as is shown in Exhibit E. To put that figure in perspective, it is equal to one quarter of the revenues we collected over that period. It has generated total savings of over $1,800 per retail consumer. We are very proud of that accomplishment. Exhibit F shows your specific savings. OVERVIEW OF BRAZOS ELECTRIC Brazos Electric was the first generation and transmission electric cooperative to be formed in Texas, and today it is the largest. In 1941, 11 rural electric cooperatives formed Brazos Electric to provide an organization that would supply them with reliable and economical power. Today, Brazos Electric has 20 members that serve in 66 counties extending from Childress to Conroe and from Brownwood to Sherman. The Cooperative also sells wholesale power to six municipal electric systems and Texas A&M University. Member -owner cooperatives and board of directors Brazos Electric is essentially consumer -directed. About half of our directors are member - consumers of their respective cooperatives. The other half are managers of our member cooperatives. They remain clearly focused on the fact that the ultimate consumer is affected by their decisions. It is that focus that has helped us to reduce our average cost of wholesale power by 26 percent since its peak in 1983 (counter to the trend of inflation). Organization The officers of the organization are a president, a vice president, asecretary-treasurer, and the executive vice president and general manager, who is the chief operating officer of the Cooperative. Our headquarters are located in Waco, where we are organized into five divisions, each headed by a manager (Exhibit G). These divisions provide essential services in all areas, including finance, accounting, administration, engineering, construction, operations, planning, and public relations. Brazos Electric has about 290 full-time employees. Operationally, it is divided into two districts. Our Southern District is headquartered in Waco and the Northern District, in -2- 1/19/94 Tolar, about six miles west of Gran bury, We have crews dispersed at Waco, Tolar, Bowie, Reagor Springs, and Belton. Brazos Electric has a subsidiary, Brazos Fuel Company, which manages gas contracts that supply all of Brazos Electric's gas needs. The sole purpose of Brazos Fuel is to achieve the best blended gas price for Brazos Electric. Facilities Brazos Electric owns 2,450 miles of 69 KV, 138 KV and 345 KV transmission line. It owns two gas -fired plants and is building two, 104 MW simple -cycle gas turbines at the Miller Plant site to be on line in mid-1994. It is a member of the Texas Municipal Power Pool from which it buys some of its capacity requirements and in which it conducts economic dispatching of the Pool's generation units. Brazos Electric buys power from several other utilities in the state, including 195 megawatts from the lignite -fired San Miguel Plant. Its generation resources are shown in Exhibit H. In 1993, Brazos Electric's peak was 978 MW. Except in years of extremely cold winters, the Cooperative peaks in the summer. Therefore, its system planning is based on summer peaking. The ratchets that we propose on our coincident and non -coincident peaks are based on summer (on -peak) demands. SYSTEM RELIABILITY A detailed discussion of Brazos Electric's quality of service will be contained in our Rate Filing Package. We are proud of our generation resources. Our transmission facilities are well maintained and monitored to insure delivery of wholesale energy without interruption. Exhibit I shows that our outage times are declining, a reflection of the continuing improvements in system reliability that we are achieving. CONCLUSION As you review our Rate Filing Package, we think that you will agree that the quality of service provided by Brazos Electric is excellent.
