HomeMy WebLinkAbout1973-Ordinance-Annexing 73.54 acres Rueben Bebee Survey-11/19/1973 ORDINANCE NO. 1/7 3 AN ORDINANCE ANNEXING TO THE CITY OF SANGER, TEXAS , A MUNICIPAL CORPORATION, 73 . 54 ACRES OF LAND, MORE OR LESS, LYING AND BEING SITUATED IN DENTON COUNTY, TEXAS , ADJACENT AND CONTIGUOUS TO THE CITY LIMITS OF SANGER, TEXAS , DESCRIBING SAID ANNEXED TERRITORY BY METES AND BOUNDS, AND PRESCRIBING THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, pursuant to the provisions of Article 974g, Revised Civil Statutes of Texas , and the Municipal Annexation Acts of the State of Texas , the sole owner of, and the sole person having an interest in, the hereinafter described territory, which is vacant and without residents , adjoining and being contiguous to the City Limits of the City of Sanger, Texas , a municipal corporation, aggregating 73 .54 acres of land, more or less , less than one-half (1/2) mile in width, described by metes and bounds in Exhibit "A" attached hereto, and incorporated herein, heretofore, on the jet-i , day of November, A. D. 1973 , presented a petition in writing to the City Council of the said City of Sanger, Texas, duly signed by said sole owner of, and the only person having an interest in, said lands , properly acknowledged as provided by law, for the annexation of said territory by ordinance to the said City of Sanger, Texas ; and WHEREAS, said petition is in due and proper form, and in compliance with law, and the above described territory, when annexed, taken together with all other land presently within the City Limits of said City of Sanger, Texas, will not exceed authorized territorial limits of the said City of Sanger, Texas , as provided by law; -1- NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS , THAT: SECTION 1 . The territory described by metes and bounds in Exhibit "A" attached hereto, and incorporated herein , as a part of this annexation ordinance, aggregating 73 . 54 acres of land, more or less , shall be and the same is hereby annexed to the said City of Sanger, Texas, and said land and territory shall hereafter be a part of the said City of Sanger, Texas , a municipal cor- poration, and all future inhabitants of said annexed territory, now vacant and unoccupied, shall be subject to all ordinances of said City of Sanger, Texas , now in force or hereafter adopted, and shall have, hold , and (possess , all rights, duties , and obligations held and possessed by all other inhabitants of said City of Sanger, Texas , and all taxable property in said annexed area shall bear its pro-rata part of all taxes levied, assessed, and collected by said City of Sanger, Texas . SECTION 2 . This ordinance shall become effective on the date of its passage, as set forth below. APPROVED this the day of November, A. D. 1973 . Williams et ux to E. P. Lineham et ux by deed dated January 28, 1947, and recorded in Volume 333 , page 52 of the Deed Records of Denton County, Texas ; THENCE in a northwesterly direction, with the East right- of-way line of old Highway No. 77 , the following calls and distances : North 50 deg. 12 min. 02 sec . West, a distance of 305 .05 feet to a R.O.W. marker; North 44 deg. 59 min. 13 sec. West , a distance of 28.25 feet to a R.O.W. marker; North 36 deg. 55 min. 20 sec . West, a distance of 99 . 82 feet to a R.O.W. marker; North 29 deg. 31 min. 34 sec . West , a distance of 93 . 83 feet to a R.O.W. marker; North 24 deg. 08 min. 02 sec.
